PROTESTING AFTER THE FIRST THREE YEARS (Yerushalmi Halachah 3 Daf 9b)
גידול בר מיניימין הוה ליה עובדא והוו דייניה חלקיה בר טובי ורב הונא וחייה בר רב.
Answer to previous question: Gidul bar Minyamin experienced such a case, that a person took possession of his land. He protested during the first three years, but not after that. He came to Beis Din with his claim. The Dayanim there were Chilkiyah bar Tuvi, Rav Huna and Chiya bar Rav.
אמר לון חייה בר רב כן אמר אבא מכיון שערר עמו שלשה שנים הראשונות עוד אין צריך לעורר עליו.
Chiyah bar Rav: My father said that if he protested during the first three years, he does not need to protest any more.
ותני כן היה אוכל שלו שש שנים ערר שלש שנים הראשונות
Support (Beraisa): If a person was consuming the product of a field for six years and the owner protested during the first three...
אמר לו אתה מכרתה לי אתה נתתה לי מתנה אינה חזקה
If the person replies, "(But after the first three years) you sold it to me" or "You gave it to me as a gift", it is not a chazakah.
[אם] מחמת טענה הראשונה (הרי זו) [אינה] חזקה [דף י עמוד א] שכל חזקה שאין עמה טענה אינה חזקה.
If the person says that he was relying on his original claim (meaning his claim from the first three years that the field was his, although he did not show a document to prove it); he has no basis for his current claim whatsoever, just as any chazakah that does not have a (real) claim backing it - is not a chazakah.
שמואל אמר אם בזו אין אנו מניחין לגדולי ארץ ישראל כלום:
Shmuel: If we behave this way (and rule that the owner does not need to protest again if he protested already during the first three years) the rich of Eretz Yisrael will not be able to live (since they normally keep their documents of sale for only three years after the owner remains silent).
