According to those who learn that the p'tur of preventing a worker from eating is only from malkos but not from the laav why do i need the drasha, is it not a laav shain bo maasah ?

The Isur of Lo Sachsom, which is the Lav referred to by the Gemara, has a Chiyuv Malkos even if the Chasimah is only done through the owner's voice (see 90b, Sefer Hamitzvos Mitzvah #219). The same way the prohibition is transgressed by an animal would be the way it is transgressed by a human as well (according to this opinion).
