WHEN A MAJORITY OF OMED PERMITS (Yerushalmi Perek 1 Halachah 8 Daf 10a)

מתני' שיירה שחנתה בבקעה והקיפוה כלי בהמה מטלטלין בתוכה ובלבד שיהא גדר גבוה י' טפחים ולא יהו פרצות יתירות על הבנין

(a)

(Mishnah): If a caravan camped in a valley and surrounded it with Kelim used for animals, one may carry inside, as long as it is 10 Tefachim tall and the area of the gaps does not exceed that of the building (what stands);

כל פירצה שהיא כעשר אמות מותרת מפני שהיא כפתח יותר מיכן אסור:

A gap up to 10 Amos is permitted. More than this forbids.

גמ' רב אדא בשם ר' חסדייא למי נצרכה לר' יוסה בי ר' יודה דר''י בי ר' יודה אומר כל מחיצה שאינה של שתי ושל ערב אינה מחיצה ומודה הוא הכא

(Gemara - Rav Ada citing R. Chisda'i): According to whom is [our Mishnah] needed? It is according to R. Yosi bei R. Yudah, for R. Yosi bei R. Yudah says, any Mechitzah that is not horizontal and vertical is not a Mechitzah. Here he agrees [even though it is only vertical. It is a leniency of a caravan].

Support (Beraisa): We may make a Mechitzah from anything, even saddles, even Avitim (pillows under saddles), even camels, as long as there is not between one saddle to the other the full [width] of a saddle, between one Avit to the other the full [width] of an Avit, between one camel to the other the full [width] of a camel;

And what stands may not be opposite what stands, and gaps opposite gaps. Rather, what stands is opposite gaps, and gaps are opposite what stands.

It turns out that regarding Kil'ayim (one may plant diverse species on opposite sides of a Mechitzah), anything less than three [Tefachim] is as if it were sealed. Between three and four [Tefachim], if what stands exceeds the gaps, it is permitted. If the gaps exceed what stands, it is forbidden.

(מארבע) [צ''ל מארבעה] עד עשר אם העומד רבה על הפרוץ מותר אם הפרוץ רבה על העומד כנגד העומד מותר כנגד הפרוץ אסור יותר מעשר אף על פי שהעומד רבה על הפרוץ כנגד העומד מותר כנגד הפרוץ אסור

Between four [Tefachim] and 10 [Amos], if what stands exceeds the gaps, it is permitted. If the gaps exceeds what stands, opposite what stands is permitted, and opposite the gaps is forbidden. More than 10, even if what stands exceeds the gaps, opposite what stands is permitted, and opposite gaps is forbidden.

אבל לענין שבת כל הפחות מג' כסתום מג' ועד ארבעה מארבעה ועד עשר אם העומד רבה על הפרוץ מותר אם הפרוץ רבה על העומד אסור. יותר מעשר אף על פי שהעומד רבה על הפרוץ אסור

However, regarding Shabbos, anything less than three is as if it were sealed. Between three and four [Tefachim], and between four and 10 [Amos], if what stands exceeds the gaps, it is permitted. If the gaps exceed what stands, it is forbidden. More than 10, even if what stands exceeds the gaps, it is forbidden.

(R. Chananyah citing R. Yudah bar Pazi citing R. Yochanan): Delete [regarding Kil'ayim] the clause "between three and four.'' There is a breach of three, and there is not an [important] place of four [Tefachim of standing width to permit even opposite itself].

התיב ר' מנא והתנינן מקיפין בקנה וקנה יש לו מקום

Question (R. Mana - Mishnah): We may surround (make a Mechitzah) of sticks. Does a stick occupy an [important] place? (It is less than four!)

Answer: Do not challenge me from there. [We permit only when they are] less than three apart, for anything less than three, it is as if it is sealed.

(R. Yosi bei R. Bun): In any case, since what stands exceeds the gaps, it is permitted.

HETERIM IN WHICH OMED MERUBAH AL HA'PARUTZ (Yerushalmi Perek 1 Halachah 9 Daf 10b)

מתני' מקיפין ג' חבלים זו למעלה מזו וזו למעלה מזו ובלבד שלא יהא בין חבל לחבירו ג' טפחים

(a)

(Mishnah): [If a caravan camped in a valley], they may surround it with three ropes, one above the other, as long as there are not three Tefachim between successive ropes;

שיעור חבלים עוביין יותר על טפח שיהא הכל עשר טפחים:

The total thickness of the ropes must be more than a Tefach, in order that the top of the top rope will be at least 10 Tefachim.

גמ' א''ר זעירא לא אמרו אלא בעשר וביותר מעשר [דף יא עמוד ב (עוז והדר)] הא פחות מיכן לא.

(b)

(Gemara - R. Ze'ira): They said [that one may surround with ropes] only when [the total thickness of the ropes exceeds a Tefach, so with the gaps it] is 10 [Tefachim] or more than 10, but not if it is less.

ותני כן הביא דופן של ז' טפחים [צ''ל ומשהו - הגהות ר' יוסף דיננער] והגביהו מן הארץ פחות מג' מותר. [צ''ל ויביא ג' חבלים - הגר''ח קניבסקי שליט''א]

Support (Beraisa): If he brought a wall of seven Tefachim and Mashehu and raised it above the ground less than three Tefachim, it is permitted [for a Sukah. If there is a solution with thin ropes,] he should bring three ropes [placed, three, seven and 10 Tefachim above the ground];

תמן את אמר כל פחות מג' כסתום. וכא את אמר כל פחות משלשה כסתום

There (the bottom three Tefachim) you say that anything less than three, it is as if it is sealed. [Also] here (the top three Tefachim) you say that anything less than three, it is as if it is sealed. (Since it is as if six Tefachim are sealed, this should permit due to Omed Merubah Al ha'Parutz!)

(d)

Rejection: You cannot ask (prove) from there. (Perhaps Omed Merubah Al ha'Parutz does not permit in a case that the Omed is a majority only when we combine both sides over the width of the breach in the middle.)

Question: The following is difficult. (Why must he bring a wall of seven?) He can bring a wall of four Tefachim and Kolshehu and raise it above the ground four Tefachim less Kolshehu! (Now, Omed Merubah Al ha'Parutz from one side.)

This is like R. Yochanan said [about Chulyas ha'Bor] - the Omed and the gap join to four, if the Omed exceeds the gap. (We explained this like HA'GAON RAV C. KANIEVSKY, SHLITA.)

(Reish Lakish citing R. Yudah ben Chananyah): If one inserted four poles in the four corners of a vineyard (one in each corner) and tied a reed on top [between adjacent poles], it saves due to Pei'ah (i.e. it is as if there is a wall under the reed and it is recognized that the vineyard ends there, so one may seed something else on the other side).

(R. Yochanan): Like walls for Kil'ayim (to permit seeding another species on the other side), so are like walls for Shabbos. (Tzuras ha'Pesach permits a gap even more than 10.)

R. Yochanan: A case occurred in which R. Yehoshua ben Korchah went to R. Yochanan ben Nuri, to Nagnagad and showed him one field called Beis Chaveirtah. There were breaches more than 10 [Amos];

והיה נוטל אעים וסותם דוקרנין וסותם עד שמיעטן פחות מעשר אמר כזו כן מחיצת שבת

R. [Yochanan ben Nuri] inserted spikes and strung Pe'ah between them to seal them, and reduce the breaches to less than 10. He said "like this, so is a Mechitzah for Shabbos.''

(R. Zeira): Reish Lakish agrees about Shabbos, that Pe'ah does not help [for breaches] more than 10.

Support (R. Chagai - Mishnah): We surround it with three ropes, one above the other;

If you say that Pe'ah saves more than 10, also one rope [at least 10 Tefachim high would permit]!

Question (R. Yonah citing R. Hoshayah): How does one put the Pe'ah - on top of [the poles], or on the side?

If you will say that it is to the side, all the more so on top [permits]! If you will say that it is on top, but to the side, no. (We explained this like BI'UR HA'GRA, Kil'ayim 4:2.)

Answer: (We infer from R. Chagai that it is even to the side.) If you will say that it is to the side, R. Chagai properly [supported R. Zeira]. If you will say that it is on top, he did not say anything (it is no support).

Objection: No matter what you will say [R. Chagai gave a proper support]! If [we can permit a breach of 10 through one rope] above, [he should put one] above! (Why does the Mishnah teach about three ropes to the side?) If [we can permit through one rope] to the side, [there is the top rope] to the side! (Why does the Mishnah obligate three ropes to the side?)

Answer (Rabanan of Kisarin citing R. Yirmeyah): The case is, the spikes are like daggers (sharp on top. In such a case, a rope would not stay on top, so the Mishnah teaches how to permit through ropes on the side. We explained this like PNEI MEIR.)

רבי זעירא ר' אבדימי דחיפה בשם רשב''ל לגובה אפילו עד מאה אמה

(R. Zeira citing R. Avdimi of Chaifa citing Reish Lakish): The height can be even until 100 Amos.

Limitation (R. Yudan): This is for Kil'ayim, but for Shabbos, Pe'ah cannot be higher than a Korah.

Question: According to Rebbi, what is the difference between a Korah and Pe'ah?

Answer: Korah permits [even though it is only on] one side. Pe'ah permits only if it surrounds on [all] four sides.

(R. Avahu): All of this is discussion, but to rule, it is forbidden to rule [to permit carrying due to Pe'ah];

Sukah is lenient (a mere Mitzvas Aseh), and you say that it is forbidden [to rely on Tzuras ha'Pesach for more than one side]. Shabbos, which is stringent (it has Kares and stoning), all the more so [we require proper Mechitzos]!

Question (R. Bun bar Chiya, to R. Ze'ira): Who taught that Pe'ah permits - was it not R. Yochanan ben Nuri? (He permitted for Kil'ayim, and also Shabbos!)
