GITIN 6 (2 Sivan 5783) - This Daf has been dedicated in memory of Harry Bernard Zuckerman, Baruch Hersh ben Yitzchak (and Miryam Toba), by his children and sons-in-law.

SUMMARY

The Shali'ach may say B'Fanai Nichtav even if he was at a distance and he heard that the Get was being written Lishmah but he could not see the writing of the Get. (1)
 
Even if the Sofer went in and out of the house during the writing of the Get it is Kosher. (2)
 
Rav says Bavel shares the same status as Eretz Yisrael and a Shali'ach who brings a Get from one Medinah to another in Bavel does not say B'Fanai Nichtav. (3)
 
Shmuel says that Bavel shares the same status as Chutz la'Aretz and a Shali'ach must say B'Fanai Nichtav. (4)
 
Rebbi Yehudah says that Medinas ha'Yam starts from Rekem to the east and from Ashkelon to the south and from Ako to the north. (5)
 
A Shali'ach that brings a Get from Ardishor to Aktisfon does not have to say B'Fanai Nichtav, but from Aktisfon to Ardishor he does have to say B'Fanai Nichtav. (6)
 
Rabah Bar Avuha required B'Fanai Nichtav from one row of houses to another and Rebbi Sheshes required B'Fanai Nichtav from one Shechunah to another. (7)
 
Rava required B'Fanai Nichtav within the same Shechunah in Mechoza. (8)
 
Even in a place that the Shali'ach is not required to say B'Fanai Nichtav if he does say it he is believed and the husband may no longer claim that the Get is Pasul.
 
Rebbi Meir says that Ako shares the same status of Eretz Yisrael with respect to Gitin, but the Chachamim argue.
 
A Shali'ach who brings a Get from Bavel to Eretz Yisrael does not have to say B'Fanai Nichtav because people travel frequently between the two countries.
 
Rebbi Yitzchak says that three words from the Torah may not be written without Sirtut (lines), but the Beraisa says four words.
 
Rebbi Evyasar says that the husband of the Pilegesh b'Giv'ah found a fly and Rebbi Yonasan says that it was a thread. (9)
 
When a person projects too much fear in his house it ends up causing three Aveiros: Giluy Arayos, Shefichas Damim and Chilul Shabbos.
 
On Erev Shabbos before dark a person must ask if the Ma'aser was separated, if the Eruv Chatzeros was made and he should instruct his wife to light the Neros.

A BIT MORE

1. Even if he was on a different floor than the Sofer he can say B'Fanai Nichtav as long as he can hear the Get was being written Lishmah.
 
2. We are not concerned for the possibility that when the Sofer left the house he met someone else with the same name who wanted a Get written and the Get that he is writing is for that persona and thus it is not being written Lishmah.
 
3. Rav holds that since there are a lot of Yeshivos in Bavel there are always people traveling from place to place and it is not difficult to find witnesses to authenticate the signatures and therefore it is not necessary to say B'Fanai Nichtav.
 
4. Shmuel holds that even though there are a lot of Yeshivos in Bavel, the Bnei Yeshivos are immersed in their learning and do not recognize the signatures of witnesses.
 
5. A Shali'ach who brings a Get from any of these places and beyond with the exception of Bavel must say B'Fanai Nichtav.
 
6. The Shuk is in Aktisfon and the people from Ardidshor are often in Aktisfon and therefore the people of Aktsifon recognize their signatures. However the people of Ardishor do not recognize the signatures of the people of Aktisfon because they are busy with the Shuk.
 
7. A Shechunah is three houses.
 
8. The people of Mechoza traveled a lot and did not even recognize the signatures of people in their own Shechunah.
 
9. Eliyahu ha'Navi said that they are both the words of Hashem. He found first a fly and he was not Makpid and then he found a thread and was Makpid.

BRIEF INSIGHT

ARDISHOR TO AKTISFON
 
A Shali'ach that brings a Get from Ardishor to Aktisfon does not have to say B'Fanai Nichtav, but from Aktisfon to Ardishor he does have to say B'Fanai Nichtav. Tosfos says that Ardishor is in Bavel and Aktisfon is in on the other side of the border in Chutz la'Aretz. However they are very close to each other on two sides of a river. Even though they were very close to each other since they were in different countries if it were not for the fact that the people of Ardishor traveled often to Aktisfon it would be difficult to find witnesses to authenticate the signatures. Since Ardishor is in Bavel the people knew the Din of Lishmah and therefore it was not necessary for the Shali'ach to say B'Fanai Nichtav.

If the Get was partially written in front of the Shali'ach and was signed in front of the Shali'ach if it was the first part of the Get that was written in front of him, even if it was only the first line, the Shali'ach may say B'Fanai Nichtav. Even if the Shali'ach heard the sound of the writing of the Get [without seeing it] and the Get was signed in front of him, he may say B'Fanai Nichtav. In addition, if the Sofer went out in the middle of the writing of the Get and came back and finished the Get it is Kosher and we are not concerned that while he was out someone with the same name requested that he write him a Get and the Get that he completed is for the other person and is thus not written Lishmah.
