SUMMARY

1. Rebbi Yosi b'Rebbi Yehudah disagrees with the Rabanan's definition of Hagramah, and Rebbi Chanina ben Antignos disagrees with Rebbi Yosi b'Rebbi Yehudah's definition of Hagramah.

2. According to the first version, Rav Asi maintains that Rebbi Yosi b'Rebbi Yehudah agrees that when the first third of the Shechitah was above the upper ring of the trachea and the final two thirds within the ring, it is Pasul.

3. According to the first version, Rav Chisda maintains that Rebbi Yosi b'Rebbi Yehudah disagrees with the Rabanan even when the first third of the Shechitah was above the upper ring of the trachea and the final two thirds within the ring.

4. Rav Huna says in the name of Rav that if one performed the first third and last third of the Shechitah above the upper ring, and the middle third within the ring, it is valid. Rav Yehudah in the name of Rav disagrees.

5. Rav Huna maintains that if one performed the first third and last third of the Shechitah within the ring, and the middle third above the ring, it is Pasul. Rav Yehudah in the name of Rav disagrees.

6. According to Rebbi Elazar, if the first half of the trachea was ripped and the Shechitah was done on the second half, it is valid, but if the Shechitah was done on the first half and the second half was ripped, it is Pasul. Rebbi Yochanan disagrees.

7. If a Yisrael cut the first half of the trachea and a Nochri cut the second half, it is Pasul, but if a Nochri cut the first half and a Yisrael cut the second half, it is valid.

8. If Shechitah or Melikah is done from the back of the head, it is Pasul.

9. Shechitah done from the back of the neck is Pasul. Melikah done from the back of the neck is Kosher.

10. If the Simanim of the bird are pulled behind its neck for the Melikah, it is Kosher.

A BIT MORE

1. Rebbi Yosi b'Rebbi Yehudah maintains that if the Shechitah cuts through the majority of the upper ring around the trachea, it is valid, even if part of the Shechitah is above the ring. Rebbi Chanina ben Antignos maintains that even if the entire Shechitah is done above the ring, it is valid.

2. It is Pasul because at the time that the majority of the trachea was cut, most of the Shechitah was not done in the correct place.

3. When one performed the first two thirds of the Shechitah within the upper ring and the final third above the ring, even the Rabanan agree that it is valid, according to Rebbi Chisda.

4. According to Rav Huna, since at the time that the majority of the trachea was cut the Shechitah was being done in the correct place, it is valid. Rav Yehudah disagrees because the majority of the Shechitah must be done in the correct place.

5. According to Rav Huna, since at the time that the majority of the trachea was cut the Shechitah was not being done in the correct place, it is Pasul. Rav Yehudah maintains that it is valid because the majority of the Shechitah was done in the correct place.

6. According to Rebbi Yochanan, even if the Shechitah was done in the first half, and the second half was ripped, it is valid because he cut everything there is to cut.

7. If a Yisrael cut the first half of the trachea, the Shechitah is Pasul, because at the time of his Shechitah the entire trachea was intact and he cut only half of it. However, if a Nochri cut the first half, it is no different from a case in which half of the trachea was found to be ripped, in which case the Shechitah is valid, because the animal is not a Tereifah unless most of the trachea was ripped.

8. Although Melikah is done from the back, it must be done from the back of the neck and not from the back of the head.

9. If the Shechitah is done from the back of the neck, the Shechitah will break the neck before the Simanim are cut, rendering the animal a Tereifah. In contrast, the Mitzvah of Melikah l'Chatchilah is to cut through the back of the neck. Since the act of Melikah is being done in the manner that the Torah prescribes, the Melikah is valid even though the bird becomes a Tereifah in the process.

10. Even a Shechitah from the back of the neck is valid if the Simanim are pulled behind the animal's neck, because in such a case the Simanim are cut without breaking the neck.
