12TH CYCLE DEDICATIONS:
 
ERUVIN 96-100 - Dedicated in memory of Max (Meir Menachem ben Shlomo ha'Levi) Turkel, by his children Eddie and Lawrence and his wife Jean Turkel/Rafalowicz. Max was a warm and loving husband and father and is missed dearly by his family and friends. His Yahrzeit is 5 Teves.

SUMMARY

1. Rav Yosef: A person who stands in Reshus ha'Rabim and urinates into Reshus ha'Yachid performs the Melachah of carrying.
 
2. The Gemara explains why this act (#1) constitutes carrying even though it lacks an Akirah (uprooting) from, and Hanachah (placing down) onto, an area that is four Tefachim wide.
 
3. If someone coughs up phlegm and spits it out in front of his Rebbi, he is liable to death at the hands of Hashem.
 
4. A person should not stand in Reshus ha'Rabim and drink from a Reshus ha'Yachid.
 
5. There is a dispute about whether this law (#4) also applies to one who is standing in a Karmelis and drinking from a Reshus ha'Yachid.

A BIT MORE

1. Rav Yosef: He would have to bring a Korban Chatas for doing so.
 
2. No area of four by four Tefachim is necessary in this case, because the person's intent gives significance to the place where the urine is "uprooted" and "placed down."
 
3. Even if he coughs something up, he should not spit it out in front of his Rebbi. If he had no choice and could not avoid it, he is not liable.
 
4. This prohibition does not apply when he puts his entire head and most of his body into the private domain while he drinks.
 
5. Abaye: The law is the same. Rava: Prohibiting drinking in this case would constitute a decree for a decree (which we do not make), and therefore one may drink in the normal manner.
