PESACHIM 6-10 - Two weeks of study material have been dedicated by Mrs. Estanne Abraham Fawer to honor the sixth Yahrzeit of her father, Reb Mordechai ben Eliezer Zvi (Rebbi Morton Weiner) Z'L, who passed away 18 Teves 5760. May the merit of supporting and advancing Dafyomi study, which was so important to him, during the weeks of his Yahrzeit serve as an Iluy for his Neshamah.

TOSFOS DH HASAM DE'MATZI MESALEK LEIH

תוס' ד"ה התם דמצי מסלק ליה

(SUMMARY: Tosfos explains the difference between this case, and the case in Bava Metzi'a, where the animal is considered the Nochri's, since where there is no money, he can take it.)

הק' ר"י, דבפ' איזהו נשך (ב"מ דף ע: ושם) אמר ד'המקבל צאן ברזל מן הנכרי, הוולדות פטורים מן הבכורה', אף על גב דמצי מסלק ליה לנכרי בזוזי, כדאמר התם 'כיון דאלו בעי נכרי זוזי ולא משכח, שקול בהמה'?

(a)

Question: The Ri asks from Perek Eizehu Neshech (Bava Metzi'a 70:) which states that if someone is 'Mekabel' sheep of Tzon Barzel (for which he accepts responsibility) from a Nochri, the babies are Patur from the Bechorah, despite the fact that he could send the Nochri away with money, as the Gemara says there 'Since, if the Nochri wanted money, but could not find any, he takes the animal'?

ותי' ר"י, דשאני התם, שמתחלה היתה הבהמה של נכרי, וכיון דאי בעי זוזי ולא משכח שקיל בהמה, לא נפקא מרשותיה.

(b)

Answer: And he answers that it is different there, since to begin with, the animal belongs to the Nochri. Consequently, since if he does not find money, he can take the animal, it has not in effect, left his domain.

אבל כשהבהמה של ישראל ומצי מסלק ליה לנכרי בזוזי, לא נכנסה לרשותו.

Answer (cont.): But in our case, where the animal belongs to the Yisrael, since he is able to send him away with money, it has not left his domain.

TOSFOS DH BEHEMAS ARNUNA PETURAH MIN HA'BECHORAH AF-AL-GAV DE'MATZI MESALEK L'HU

(SUMMARY: Tosfos disagrees with Rashi's explanation to reconcile the current Beraisa and the Beraisa which rules 'Chayav'.)

והא דתניא 'חייבת'?

Implied Question: Why does the Beraisa then say that it is Chayav?

פ"ה, דגבי עיסה תניא.

(b)

Answer #1: Rashi explains that the Tana is talking (not about an animal, but) about a dough.

וק' לרשב"א, דהא גבי בהמה תניא בהדיא בתוספתא דחייבת בבכורה?

(c)

Question #1: The Rashba queries Rashi however, in that the Beraisa in the Tosefta specifically states that it is subject to the Bechorah.

וכן גבי עיסה תניא, 'עיסת ארנונא חייבת בחלה', אע"ג דלא מצי מסלק ליה.

(d)

Question #2: Another Beraisa issues the same ruling with regard to a dough, which it renders Chayav Chalah, even there where he cannot send him away with money (see Maharsha).

ואית ספרים דגרסי 'בהמת ארנונא פטורה, והוא דלא מצי מסלק ליה'.

(e)

Answer #2: Some versions have the text that exempt an animal of Arnona from the Bechorah, provided he cannot send him away with money ...

Answer #2 (cont.): According to this text, one can reconcile both Beraisos (since both Beraisos can then be speaking about an animal without clashing (see Maharsha).

TOSFOS DH YICHAD LO BAYIS

תוס' ד"ה יחד לו בית

(SUMMARY: Tosfos explains why, unlike Rashi, the Beraisa must be speaking where the owner accepted liability on the Nochri's Chametz.)

פ"ה, 'דלא קיבל עליו אחריות, אלא אמר ליה "הרי הבית לפניך".

(a)

Explanation #1: Rashi establishes the case where the owner did not accept liability (on the Nochri's Chametz), but merely said 'Here is the room before you!'

וק' לר"י, מאי איריא יחד, אפילו לא יחד נמי?

(b)

Question: The Ri asks however, that in that case, he ought to be Patur from destroying it even if he did not designate the room?

והיכי נמי מסיק בסמוך 'למימרא דשכירות קניא?'

Answer #2 (cont.): Furthermore, how can the Gemara state shortly 'This means to say that renting acquires?'

ופר"ת, דאפילו באחריות מיירי; ומשום הכי מפיק מ"לא ימצא", דלא חשיב מצוי כיון שיחד לו בית.

(c)

Explanation #2: Rabeinu Tam therefore explains that it speaks even where he did accept liability. And that is why the Gemara learns it from "Lo Yimatzei" (see Maharsha), because, since he designated a room, it is not considered 'Matzuy'.

ורב פפא אית ליה מסברא כיון שיחד לו בית, הוי כאלו קיבל עליו אחריות על חמצו של נכרי בביתו של נכרי.

Explanation #2 (cont.): Whereas Rav Papa learns it from a S'vara, seeing as he designated him a room, it is akin to accepting liability on the Chametz belonging to a Nochri in the Nochri's domain.

TOSFOS DH KOFEH ALAV K'LI

תוס' ד"ה כופה עליו כלי

(SUMMARY: Tosfos reconciles this ruling even according to those who forbid taking a vessel for any purpose other the one it was originally designated.)

אע"ג דאיכא למ"ד בפ' כירה (שבת מג.) 'אין כלי ניטל אלא לדבר הניטל'?

(a)

Implied Question: Even though there is an opinion in Perek Kirah (Shabbos 43.) that declares forbidden taking a vessel for anything other than what it is made for?

איכא לאוקמי בצריך למקומו.

(b)

Answer #1: One an establish the case where he picked up the vessel because he needed to use its location (which is permitted).

אי נמי, הכא שרי משום דילמא אתי למיכליה.

(c)

Answer #2: Alternatively, it is permitted here, because one may come to eat it (thereby transgressing an Isur Kareis).

TOSFOS DH SHE'NE'EMAR VAY'HI ANASHIM

(SUMMARY: Tosfos refutes Rashi's explanation of 'Parshas Teme'im' in Gitin, based on the current Sugya.)

והא דאמר בהניזקין (גיטין ד' ס. ושם) 'שמונה פרשיות נאמרו ביום שהוקם המשכן - והיינו בראש חדש ניסן - פרשת טמאים'; לא כפ"ה דפי' פרשת טמאים "ויהי אנשים", דזו הפרשה נאמרה בערב הפסח כדמשמע הכא.

(a)

Refutation (Explanation #1): When the Gemara in 'ha'Nizakin' (Gitin 60.) cites the Parshah of Teme'im as one of the eight Parshiyos that were said on the day the Mishkan was set up (Rosh Chodesh Nisan), it is not referring to the Parshah of "Vay'hi Anashim", which was said on Erev Pesach, as is implied here ...

אלא פרשת טמאים - טומאת תרומה וקדשים.

Explanation #2: It is referring to that of Tum'as Terumah and Kodshim (in Emor).

TOSFOS DH U'MAZHIR AL PESACH SHEINI

תוס' ד"ה ומזהיר על פסח שני

(SUMMARY: Tosfos reconciles this statement bearing in mind that he needed to tell them about Pesach Sheini following their request.)

אע"ג שעל ידי שאילתן הוזקק לומר להן ...

Implied Question: Even though Moshe told it to them following their request (and not of his own volition).

מ"מ לא היה צריך להאריך אלא 'אל תעשו פסח!' ותו לא.

(b)

Answer: It would nevertheless have sufficed for him to reply 'Don't bring the Korban Pesach!', and no more. The rest he said, according to Raban Shimon ben Gamliel, because it was fourteen days before Pesach.

TOSFOS DH MIMAI DE'VE'RESH YARCHA KA'I

תוס' ד"ה ממאי דבריש ירחא קאי

(SUMMARY: Tosfos reconciles the Kashya with the Gemara in Shabbos, which seems to take for granted the fact that "ha'Chodesh ha'Zeh" was said to Moshe on Rosh Chodesh, and goes on to explain why the Gemara there does not learn a Gezeirah-Shavah from the Pasuk here.)

תימה, דבשבת בפ"ר עקיבא (דף פו: ושם) קאמר רבא 'דכ"ע בר"ח אתו למדבר סיני - כתיב הכא "ביום הזה באו מדבר סיני", וכתיב התם "החדש הזה ... "; מה להלן ר"ח, אף כאן ראש חדש.

Question: According to Rava in the Gemara in Shabbos in Perek Rebbi Akiva (86: & 87.) that everybody agrees that they arrived in Midbar Sinai on Rosh Chodesh; and he learns it from the Pasuk there in Yisro "ba'Yom ha'Zeh Ba'u Midbar Sinai" with a Gezeirah-Shavah from the Pasuk in Bo "ha'Chodesh ha'Zeh.

אלמא פשיטא "דהחדש הזה" נאמר לו בר"ח; והיינו משום דאמר בהקומץ רבה (מנחות כט.) שנתקשה משה רבינו בראיית הלבנה עד שאמר לו הקב"ה 'כזה ראה וקדש'?

Question (cont.): So we see that the Gemara takes for granted that "ha'Chodesh ha'Zeh" was said to Moshe on Rosh Chodesh (so what is the Gemara asking here)?

ותי' ר"ת, אע"ג שאמר הקב"ה למשה בריש ירחא, דילמא משה לא אמר להם לישראל אלא בג' או בד' בירחא,

(b)

Answer #1: The Ri answers that even though Hash-m said it to Moshe on Rosh Chodesh, it is possible that Moshe only told it over to Yisrael on the third or the fourth of the month.

ומסיק דיליף "מדבר" "ממדבר" - דבההיא ד"באחד לחדש השני" אמירת הקב"ה; ואמירת משה הוי בריש ירחא, דכתיב "באחד לחדש השני ויתילדו .... ".

Answer #1 (cont.): The Gemara concludes that we learn it with a Gezeirah-Shavah "be'Midbar" (Beha'aloscha) from "be'Midbar" (Bamidbar), since it says in Bamidbar "be'Echad la'Chodesh ha"Sheini", which is when Hash-m spoke to Moshe; and we know that Moshe passed it on to B'nei Yisrael on Rosh Chodesh too, since the Pasuk writes there "be'Echad la'Chodesh ha'Sheini, Vayisyaldu ... ".

ור"י מפרש, אע"ג ד"החדש הזה" הוה בריש ירחא, מיהו דילמא הא דקאמר "דברו אל כל עדת ישראל" לא הוה בריש ירחא.

(c)

Answer #2: The Ri however, explains (the Gemara's Kashya) in that, even though "ha'Chodesh ha'Zeh" was said on Rosh Chodesh, perhaps "Dabru el Kol Adas B'nei Yisrael" was not?

ואם תאמר, אמאי לא יליף התם "מדבר" מ"במדבר" כי הכא?

(d)

Question: Why does the Gemara in Shabbos not learn (that they arrived in Midbar Sinai on Rosh Chodesh) via a Gezeirah-Shavah "Midbar" from "ba'Midbar" here?

וי"ל, ד"מדבר" מ"במדבר" לא ילפינן.

(e)

Answer: We do not learn "Midbar" from "ba'Midbar" (if we can learn it from "Midbar").

TOSFOS DH AVAL BE'CHAD INYANA MAI DE'MUKDAM MUKDAM

תוס' ד"ה אבל בחד עניינא מאי דמוקדם מוקדם

(SUMMARY: Tosfos explains why it is that sometimes we do not say this.)

היינו דוקא היכא דליכא דרשה וטעם ...

Clarification: That is specifically where there is nothing to learn from changing the order.

דהא תנן בפ' נגמר הדין (סנהדרין מה. ושם) ד'דחיית הנסקל קודם לסקילתו', אע"ג דסקילה כתיב ברישא - דכתיב "כי סקל יסקל או ירה יירה"

(b)

Proof: For we find the Mishnah in Perek Nigmar ha'Din (Sanhedrin 45. & 45:) places pushing down the person being stoned before one actually stones him, even though the Torah reverses the order in Parshas Yisro, where it writes " ... and you shall stone them ... and push them down".

היינו משום דכתיב במקום אחר סקילה בגמר מיתה דכתיב "וסקלתם באבנים ומתו".

Proof (cont.): That's because in Parshas Shoftim, the Torah inserts Sekilah just before death, when it writes "and you shall stone them ... and they shall die.

TOSFOS DH AVAL BI'TREI INYANEI EIN DANIN

Implied Question: Then why does the Gemara suggest, at the end of 'ha'Parah' (Bava Kama 54: & 55.) that "Behemt'cha" of the first Dibros and "Shor va'Chamor" of the second Dibros should form a 'K'lal u'Perat'. To which the Gemara answers that " Behemt'cha" of the second Dibros makes up a 'K'lal u'Perat, u'Kelal" 'P'rat' (even though the P'rat and the second K'lal are far away from the first K'lal)?

היינו משום דעשרת הדברות חשיבי כחד עניינא, דבדיבור אחד נאמרו.

(b)

Answer: That is because the two sets of Aseres ha'Dibros are counted as one Inyan, since they were said in one go.

TOSFOS DH VE'DA'ATEI ILAVEI

(SUMMARY: Tosfos explains why they disagree with Rashi interpretation of 'Da'ateih Ilavei'.)

Explanation #1: This means that they are not automatically Bateil, like crumbs are.

ועל פ"ה קשה, מאי פריך 'כי משכחת ליה, ניבטלה!' הא פי' 'ודעתיה עילויה' - שחס עליה לבטלה?

(b)

Refutation (Explanation #2): Whereas according to Rashi, who explains 've'Da'teih Ilaveih' to mean that he is reluctant to declare it Bateil, how can the Gemara then ask 'Let him declare it Bateil when he finds it?'

TOSFOS DH MI'SHEISH SHA'OS U'LEMA'ALAH

(SUMMARY: Tosfos proves why 'from six hours' must mean from the end of six hours, and not from the beginning, like Rashi.)

Explanation #1: Rashi explains this to mean 'from the beginning of the sixth hour'.

ולא נהירא לר"ת, דע"כ הא דאמר לעיל 'חמץ מו' שעות ולמעלה אסור', היינו מסוף שש?

(b)

Refutation: This does not seem right however, according to Rabeinu Tam, since when the Gemara said earlier (Daf 4:) that Chametz from the sixth hour and onwards is forbidden, it definitely refers to the end of the sixth hour (see Maharsha).

ופר"ת, דמסוף שש קאמר.

(c)

Explanation #2: Rabeinu Tam therefore establishes it by the end of the sixth hour.
