תוס' ד"ה דבר הראוי להיות קודש פרט לאוכל תרומת חמץ

(SUMMARY: Tosfos clarifies this statement and reconciles it with the Gemara on the following Daf.)

פי' - הפסוק משמע שיתן לו דבר הראוי להיות קודש, כמו שאכל.

(a)

Clarification: This means that the Pasuk implies that he must pay the Kohen something that is fit to become Kodesh, like what he ate.

וא"כ מה שאכל בעינן דבר הראוי להיות קודש, וחמץ בפסח אינו ראוי להיות קודש, כדתניא לעיל 'אבל מפריש תרומת חמץ, ד"ה אין קדוש'.

Clarification (cont.): In that case, what he ate must have been fit to become Kodesh, and Chametz on Pesach is not fit to become Kodesh, as we learned above 'But everybody agrees that if someone designates T'rumas Chametz (on Pesach), it is not Kodesh'.

אע"ג דב כל ענין פטור הכא מתשלומין, אפי' שהיה לה שעת הכושר.

Clarification (cont.): Even though he is Patur from paying in any case, even if it had a Sha'as ha'Kosher (i.e. there was a time where it was permitted).

ולקמן מוקמא הא דל'ד"ה אין קדוש', היינו שלא היה לה שעת הכושר?

(b)

Implied Question: Whereas later (on Daf 33.), the Gemara will establish the Beraisa 'that everyone agrees that it is not Kadosh' specifically where it did not have a Sha'as ha'Kosher?

אור"ת היינו לרבי יוסי הגלילי, אבל לראב"י הואיל וסבירא ליה דחמץ בפסח אסור בהנאה, אפילו היה לה שעת הכושר, אין ראוי להיות קודש, דאין כאן נתינה.

Answer: Rabeinu Tam establishes that statement like Rebbi Yossi ha'Gelili (who holds that Chametz on Pesach is Mutar be'Hana'ah), but according to Rebbi Eliezer ben Ya'akov (who holds that it is Asur), even if it had a Sha'as ha'Kosher, it is considered unfit to become Kadosh, seeing as there is no Nesinah (giving [See Maharsha]).

והיינו דקאמר ליה ראב"י 'מה הנאה יש לו בה', כלומר הואיל ואין לו הנאה בה, אית ליה למעוטי מקרא כדפרישית.

(d)

Conclusion: And this is what Rebbi Eliezer ben Ya'akov said to Rebbi Eliezer Chisma 'What benefit does get from it?' - in other words 'Seeing as he is not permitted to derive benefit from it, it is precluded from the Pasuk', as we explained.

TOSFOS DH VE'EIN NESINAH PACHOS MI'SHAVEH P'RUTAH

תוס' ד"ה ואין נתינה פחות משוה פרוטה

(SUMMARY: Tosfos first discusses when we say Nesinah is a Shaveh P'rutah and when we don't, and then queries Rebbi Yehudah who learns that the Chiyuv Shemen ha'Mishchah on a Zar is a k'Zayis from a Gezeirah-Shavah from T'rumah.)

ורבנן נמי לא פליגי אלא משום דכתיב 'אכילה'.

(a)

Clarification: And the Rabbanan too, only argue because the Torah writes 'Achilah'.

וא"ת, והא קיימא לן (חולין דף קלז:) ד'חטה אחת פוטרת את הכרי' - אע"ג דכתיב בה 'נתינה' דכתיב "תתן לו"?

(b)

Question #1: But we Pasken in Chulin (Daf 137:) that one grain exempts the entire pile (from Ma'sros), even though the Torah writes there 'Nesinah'- "Titein lo"?

ובהזהב (ב"מ מז.) אמר 'קונין בכלי אע"פ שאין בו שוה פרוטה' - אע"ג דכתיב "ונתן לרעהו"?

Question #2: Likewise, in ha'Zahav (Bava Metzi'a 47.) the Gemara says that 'One can acquire with a vessel even if it is not worth a P'rutah - despite the fact that the Torah writes there "Venasan le'Re'eihu"?

וגבי גט נמי אמרינן (גיטין דף כ.) 'כתבו על איסורי הנאה, כשר' - אע"ג דכתיב "ונתן בידה"?

Question #3: And again with regard to Gitin, the Gemara says in Gitin (Daf 20.) that 'If one writes a Get on Isurei Hana'ah, it is Kasher', even though it writes there "Venasan be'Yadah"?

ויש לומר, דהכא ודאי בעינן שוה פרוטה, דנתינה קיימא א'תשלומין ..

Answer: The reason that we need a Shaveh P'rutah here is because Nesinah is written in connection with the payment ...

והוי כמו השבת גזילה שאין בפחות משוה פרוטה, ולהכי משום דכתיב "ונתן", משמע שפיר נתינה חשובה.

Precedent: Similar to returning a stolen article which may not be less than the value of a P'rutah - because it writes there "Venasan" (by the payment), which implies a significant Nesinah.

אבל שאר מילי אע"ג דכתיב בהן 'נתינה', לא בעינן שוה פרוטה.

Conclusion: But other things, even though the Torah writes by them 'Nesinah', do not require a Shaveh P'rutah.

מיהו קשה לר"י, דרבי יהודה דריש בכריתות (דף ו:) "ואשר יתן ממנו על זר" - בכזית, ויליף 'נתינה' 'נתינה' מתרומה ...

Question #1: The Ri asks from the beginning of K'risus (Daf 6:) where the Gemara Darshens from the Pasuk "va'asher Yiten mimenu al Zar"- a k'Zayis, which it learns via a Gezeirah Shavah from T'rumah.

וא'דיליף מתרומה בכזית, לילף מכל נתינה לחומרא, דהוו בכל שהוא, כגון מתן דמים ומתן בהונות שאין בהן שיעור?

Question (cont.): Why does it not rather learn from all other Nesinos le'Chumra - that one is Chayav on a Kolsh'hu, like Matan Damim and Matan Behonos, which have no Shi'ur

והוי נמי דומי' דסיכה, דהוי בכל שהוא?

Implied Question: Even though we learn 'Davar ha'Ra'uy Lih'yos Kodesh' from "es ha'Kodesh" ...

אצטריך נמי "ונתן", דאי כתב "את הקודש" לחודיה, ה"א דלא אתא למעוטי אלא מעות, אבל כל פירות ישלם.

Answer: We still need "ve'Nasan", because had it only written "es ha'Kodesh", we would have thought that it only comes to exclude money, but that he may pay with any fruit ...

TOSFOS DH ME'ILAH SHE'LO CHAYAV BAH KARES EINO DIN SHE'PATAR BAH ES HA'MEIZID

תוס' ד"ה מעילה שלא חייב בה כרת אינו דין שפטר בה את המזיד

(SUMMARY: Tosfos first queries this from the Gemara in Makos and from the four cases of people who swear be'Meizid, then asks on a Gemara in K'risus.)

תימה, נימא 'היא הנותנת' - דשאר מצות שהן חמורות שהן בכרת, אין לזדונה כפרה, אבל מעילה שהיא קלה שאין בה כרת, יש לזדונה כפרה?

(a)

Question #1: Perhaps that is why? Precisely because other Mitzvos carry the stringency of Kareis, that is why their Meizid is not subject to Kaparah; whereas the Meizid of Me'ilah, which is more lenient in that it is not Chayav Kareis, is?

וכה"ג איכא בריש מכות (דף ב:) דקאמר 'ק"ו - ומה הוא שעושה מעשה במזיד, אינו גולה, עדים שלא עשו מעשה, אינו דין שלא יגלו?'

(b)

Precedent: Indeed, the Gemara uses this very S'vara in Makos (Daf 2:), where it says 'Kal-va'Chomer - If already someone who performed an act be'Meizid does not go into Galus, witnesses, who did not, ought certainly not to go into Galus?

'היא הנותנת - הוא שעשה מעשה במזיד לא יגלה, כי היכי דלא תיהוי ליה כפרה; הן שלא עשו מעשה, יגלו, דתיהוי להו כפרה?

Precedent (cont.): And the Gemara answers: 'That is why! The one who performed an act be'Meizid does not go into Galus so as not to allow him a Kaparah, whereas they (the witnesses), who did not, should go into Galus, in order to attain a Kaparah.

ועוד, ארבעה המביאין על הזדון כשגגה יוכיחו - דאין בהן כרת, וחייבין על זדונם: הבא על שפחה חרופה, ונזיר טמא, ושבועת העדות, והפקדון (תוספתא דכריתות פ"א)?

Question #2: Moreover, the four people who bring a Chatas on a Meizid (somebody who has relations with a Shifchah Charufah, a Tamei Nazir, and someone who swears a Shevu'as ha'Eidus or a Shevu'as ha'Pikadon) will prove otherwise - since they are not subject to Kareis, yet they are Chayav even be'Meizid?

ואומר ר"י, דשפיר פריך בלאו הכי - 'לא אם אמרת ... '.

Answer: The Ri answers that the Gemara queries the statement anyway (i.e. it could have asked these questions too).

ומיהו קשה לר"י, אמאי איצטריך בכריתות (דף ט.) בשפחה חרופה "אשר חטא", לרבות זדון'? וגבי נזיר נמי דריש מ"פתאום", לרבות זדון?

Question: The Ri asks why the Gemara in K'risus (Daf 9.) needs the Pasuk "asher Chata" and "Pis'om" to include Zadon by Shifchah Charufah and Nazir respectively?
