IF REVAI IS NOT LEARNED FROM MAASER SHENI (Yerushalmi Maaser Sheni Perek 5 Halachah 2 Daf 29b)
אמר רבי אחא זאת אומרת שבית המקדש עתיד להיבנות קודם למלכות בית דוד
(R. Acha): This shows that the Beis HaMikdash will be built before the kingdom of the House of David.
[דף ל עמוד א] [דף מט עמוד ב (עוז והדר)] דכתיב (דברים לב) ודם ענב תשתה חמר ואת אמרת הכין:
Proof: The pasuk states (Devarim 32:14), "it would drink the blood of grapes like the finest wine"...? (Blood of grapes alludes to the coming of Mashiach (ben David) and the pasuk indicates that there will be a large amount of wine available when the House of David is re-established. But according to R. Yosi in our Mishnah (Erchin 5(c)), it was stipulated that when the Beis HaMikdash will be rebuilt speedily in our days, the original decree will return (requiring fruits within a day's journey to be brought). Therefore it must be that the Beis HaMikdash will first be rebuilt, and at that point the original decree will return. Then, when the House of David will be re-established, there will no longer be a need for the decree, since wine will become plentiful.)
תני רבי אומר במה דברים אמורים בשביעית אבל בשאר שני שבוע בית שמאי אומרים יש לו חומש ויש לו ביעור.
(Tosefta) (Rebbi): (The Mishnah taught - Kerem Revai - Beis Shammai say that it has no extra fifth (if it is redeemed) and has no requirement of Biur. Beis Hillel say that both apply.) Beis Shammai was referring to Revai in Sheviis, but in all other years, it has a requirement of the extra fifth and of Biur.
על דעתיה דהדין תנייה לא למדו לנטע רבעי אלא ממעשר שני. כמה דתימר אין מעשר שני בשביעית ודכוותיה אין נטע רבעי בשביעית.
According to that Tosefta, the laws of Neta Revai were learned from Maaser Sheni - just as Maaser Sheni doesn't apply in Sheviis; so too the laws of Revai.
מעתה אל יהיו לו קדושה. .
Question: If so, Revai shouldn't have any Kedushah in Sheviis?
קדושתו מאיליו למדו (ויקרא יט) קודש הילולים הרי הוא כקודש שקורין עליו את ההלל.
Answer: It has automatic Kedushah, as the pasuk states (Vayikra 19:24), "...all its fruit shall be holy, a praise" - it is like Kodesh (Bikurim) upon which one recites praises. (Since Revai is compared to Bikurim, it applies in Sheviis like Bikurim.)
ויהא מותר לאונן
Question: (If we don't learn Revai from Maaser Sheni in Sheviis) it should be permitted to an Onen (one who is before or on the same day as the burial of a close relative)?
תני [קודש] מגיד שהוא אסור לאונן.
Answer: The word 'holy' teaches that it is prohibited to an Onen like Bikurim.
ויהא חייב בביעור.
Question: (If it's learned from Bikurim) it should be obligated in Biur?
[דף נ עמוד א (עוז והדר)] בגין רבי שמעון דרבי שמעון פוטר מן הביעור.
Answer: Beis Shammai follow R. Shimon, who says that Bikurim are exempt from Biur.
ויפדה במחובר לקרקע.
Question: If we do not learn it from Maaser Sheni, one should be able to redeem it whilst it's attached to the ground? (The Gemara leaves this question unanswered.)
תני רבן שמעון בן גמליאל אומר אחד שביעית ואחד שאר שני שבוע בית שמאי אומרים אין לו חומש ואין לו ביעור.
(Tosefta) (Rabban Shimon ben Gamliel): (Disagreeing with Rebbi) Both in Sheviis and in all other years, Beis Shammai say that there is no fifth and no Biur.
על דעתיה דהדין תנייא לא למדו נטע רבעי ממעשר שני כל עיקר.
According to that Tosefta, the laws of Neta Revai were not learned from Maaser Sheni at all.
מעתה אל יהא לו קדושה
