(a)

(Beraisa): One who was Me'arev can give Reshus to one who was not Me'arev. Two who were not Me'arev can give Reshus to two who were Me'arev or to one who was not Me'arev. However, one who was Me'arev cannot give Reshus to one who was not Me'arev, and two who were Me'arev cannot give Reshus to two who were not Me'arev.

Everyone can give Reshus and receive Reshus, except for two who not were Me'arev. They can give Reshus, but cannot receive Reshus.

רב חסדאי אמר עשרה ישראל שהיו דרין בבית אחד כל אחד ואחד צריך לבטל רשותו

(Rav Chisdai): If 10 Yisraelim lived in one house (and this house was not Me'arev), each one must be Mevatel his Reshus.

(R. Yosa): If 10 Nochrim lived in one house, each one must rent out his Reshus.

(R. Yosa citing R. Yochanan): If a Yisrael and Nochri live in one house, the Halachah is, a Yisrael must be Mevatel his Reshus, (but not rent, lest he rent for less than a Perutah), and the Nochri must rent (but his Bitul does not help).

(R. Ba): A case occurred in which a Persian's (Nochri's) wife rented her Chatzer without her husband's consent. It came in front of R. Shmuel, and he permitted.

Assumption: They thought to say that even [a Nochri's] house-servant or harvester [can rent on behalf of the Nochri].

Question: The Nochri should [be able to] be Mevatel!

Answer: He will retract.

Answer: From now [that he received rental] and onwards, [if he retracts, it is not a retraction]. His use is theft.

Question: How much [must one pay the Nochri to rent his Reshus]?

Answer #1: We learn from the following. R. Yosa citing R. Mana bar Tanchum, and R. Avahu citing R. Yochanan said that land is not acquired for less than Shaveh Perutah.

מילתיה דרבי יעקב בר אחא אמר אפילו באגוז אפילו בתמרה.

Answer #2: We learn from R. Yakov bar Acha that it is even for a nut, and even for a date;

רבי יעקב בר אחא כד הוה נפק לאכסנייא אין הוה משכח מיעבד תקנה הוה עבד ואין לא מבדר מנוי יהב חוטרא הכא סנדלא הכא דייסיקיא הכא

When R. Yakov bar Acha needed to find lodging, if he was able to fix matters (rent from the Nochri for a Perutah before Shabbos), he did so. If not (on Shabbos he gave to the Nochri a nut or date, which looks like a gift, and not like rental - MESHIV DAVAR 1:27), he scattered his Kelim in all corners of the house - his staff here, his shoe here, his sack here. (OHR SOMAYACH Hilchos Eruvin 2:12 - surely this is not needed if he paid a Perutah. Rather, he gave less than a Perutah. A Nochri removes his ownership due to less than a Perutah, but a Yisrael acquires only through a Perutah. Therefore, he needed to scatter his Kelim to acquire the house.)

Limitation (R. Matanya): This is for a Nochri innkeeper, but a Yisrael innkeeper is not suspected to carry. (If he forgot to be Me'arev, it suffices that he said that he is Mevatel.)

WHEN ONE MAY GIVE OR BE MEVATEL RESHUS (Yerushalmi Perek 6 Halachah 4 Daf 39b)

(Mishnah): Question: When may one give Reshus?

בית שמאי אומרים מבעוד יום

Answer #1 (Beis Shamai): One may give Reshus [only] during the day (before Shabbos);

Answer #2 (Beis Hillel): One may give Reshus [even] after dark (on Shabbos).

R. Meir says, if someone gave Reshus and then took something out, whether this was b'Shogeg or b'Mezid, he forbids;

(Gemara): Our Mishnah means as follows. When may one be Mevatel Reshus? Beis Shamai say, during the day. Beis Hillel say, even after dark. (Bitul is mere withdrawal. "Giving'' is a Kinyan. The Gemara will ask if Beis Hillel permit giving Reshus after dark.)

If you would not say so (rather, we discuss acquiring Reshus, Beis Shamai would permit even during the day, and Beis Hillel only after dark), our Mishnah would be a leniency of Beis Shamai and a stringency of Beis Hillel. (If so, it should have been taught in Maseches Eduyos!)

(Mishnah): If someone gave Reshus, and took something out...

Note: There is an implied question. This connotes that the others acquired. If so, the giver cannot forbid!

כיני מתניתא מי שביטל רשותו והוציא בין שוגג בין מזיד הרי זה אוסר.

Answer #1: Our Mishnah means that he was Mevatel his Reshus and then took something out. Whether this was b'Shogeg or b'Mezid, he forbids.

Answer #2: Our Mishnah should say that he does not forbid. (We said so above at the end of Halachah 2 (39a), to avoid a contradiction in R. Meir. We explained all this like NO'AM YERUSHALMI.)

תני שנים שהיו שותפין בחצר ומת אחד מהן ונפל הבית ירושה לאחד מן השוק עד שלא חשיכה (הרי זה אוסר משחשיכה אינו) [צ''ל אינו אוסר משחשיכה הרי זה - פני משה, ע''פ תוספתא] אוסר.

(Beraisa): If two were partners in a Chatzer, and one of them died, and the house fell for an inheritance to someone from the market (i.e. not from the Chatzer) before dark, he does not forbid. If [he died] after dark, he forbids.

(R. Acha citing R. Chinena): This is like Beis Shamai, for Beis Shamai say that we cannot be Mevatel Reshus after dark. Beis Hillel say that we can be Mevatel Reshus after dark! (A Beraisa below teaches that whenever it was forbidden at the start of Shabbos, the entire Shabbos is forbidden, except for Bitul Reshus);

א''ר יוסה בי ר' בון מכיון שמת אין ביטול רשות גדול מזה.

(R. Yosi bei R. Bun): Since he died, there is no greater Bitul Reshus than this! (We explained this like HA'GAON RAV C. KANIEVSKY, SHLITA.)

הרי שהיה לאחד מן השוק בית עמהן בחצר ומת ונפל הבית ירושה לאחד מהן עד שלא חשיכה הרי זה אוסר משחשיכה אינו אוסר

(Beraisa): If someone from the market had a house with them in the Chatzer, and he died, and the house fell for an inheritance to one of them (a member of the Chatzer) before dark, he forbids. If [he died] after dark, he does not forbid.

עוד היא דבית שמאי. דבית שמאי אומרים אין מבטלין רשות משתחשך ובית הלל אומרים מבטלין רשות משתחשך.

Also this is like Beis Shamai, for Beis Shamai say that we are not Mevatel Reshus after dark, and Beis Hillel say that we are Mevatel Reshus after dark.

Question: May one rent Reshus after dark?

ר' חייה ר' יסא רבי אימא סלקון לחמתה דגדר שאלון לרבי חמא בר יוסף ושרא.

Answer (R. Chiyah citing R. Yosa): R. Eima went to Chamasah of Geder. (The Nochri in the Chatzer was away, and came on Shabbos. R. Eima) asked R. Chama bar Yosef, and he permitted.

שמעון ר' יוחנן ומר יפה עשיתם שמע ר''ש בן לקיש ומר לא עשיתם יפה

R. Yochanan heard this and said "you did properly.'' Reish Lakish heard this and said "you did not do properly.''

Question: Do they argue?

ר' זעירא אמר לא פליגין מאן דמר יפה עשיתם ששכרתם ומאן דמר לא עשיתם יפה שטילטלתם.

Answer #1 (R. Ze'ira): They do not argue. The one who said "you did properly'' refers to renting (it is permitted on Shabbos, for he is not Makneh Reshus - R. MEIR SIMCHAH). The one who said "you did not do properly'' refers to carrying (once the Nochri came, the Eruv is invalid. Renting does not suffice. All of the Yisraelim must be Mevatel to one of them.)

[דף מ עמוד ב] רבי בא אמר פליגי מאן דמר יפה עשיתם ששכרתם ושטילטלתם מאן דמר לא עשיתם יפה לא ששכרתם ולא שטילטלתם.

Answer #2 (R. Ba): They argue. The one who said "you did properly'' refers to renting and carrying. The one who said "you did not do properly'' refers to renting (he is Makneh Reshus) and carrying.

(R. Ba): This applies to even to walls (if Nochri built or destroyed walls on Shabbos, it does not affect the Heter or Isur).

היך עבידא היו שנים ועירבו עירבו אחד [דף מג עמוד ב (עוז והדר)] ובא העכו''ם והוסיף כבר נכנסה שבת באיסור.

What is the case? There were two, and they made one Eruv (there was Karmelis or Reshus ha'Rabim in between, so it did not help), and a Nochri came and added [walls that would enable an Eruv]. Shabbos already entered b'Isur (so it is forbidden even now that there are walls).

היו שלשה ועירבו שני עירובין ובא העכו''ם ופחת כבר נכנסה שבת בהיתר.

If there were three, and they made two Eruvin (i.e. each was Me'arev by itself), and a Nochri came and opened [the walls between them]. Shabbos already entered b'Heter (so it is still permitted).

חייליה דרבי בא מן הדא כל שבת שנכנסה בהיתר מותר באיסור אסור חוץ מן המבטל רשות.

Source: R. Ba learns from [a Beraisa] "any Shabbos that entered b'Heter, it is permitted. If it was forbidden [at the start of Shabbos, the entire Shabbos is] forbidden, except for one who is Mevatel Reshus.

(ומ''ד) [צ''ל ואית דאמרי - קרבן העדה] חוץ מן המבטל ומן המשכיר.

Some say, except for one who is Mevatel and one who rents out [his Reshus].

Question: May one rent from the innkeeper (a Nochri, who rented the Dirah to another Nochri)?

ר' חיננא ור' יונתן סלקין חמתה דגדר אמרין נמתין עד שיבואו זקני הדרום לכאן אתא רבי נתן דרומה ושאלון ליה ושרא

Answer #1: R. Chinena and R. Yonason went to Chamasah of Geder. They said, we will wait here until Chachamim of the south come to here. R. Nasan of the south came. They asked him, and he permitted.

שמע רשב''ל ואמר מאחר שהעכו''ם בא ומוציאנו לא עשינו כלום.

Answer #2 (Reish Lakish): Since the Nochri [who rented from the innkeeper] can come and expel us, we did not do anything (renting from the innkeeper is invalid).

שמעון בר בא א''ר יוחנן בעי מעתה אין בתינו שלנו.

Question (Shimon bar Ba citing R. Yochanan): If so, our houses are not ours! (The king's soldiers can come and dwell in our houses against our will!)

רבי יוסטי בי ר' סימון בשם ר' בייתוס אין בתינו שלנו לדור עמנו הא לצאת אין מוציאין אותנו ובפונדק מוציאין אותנו:

Answer (R. Yosti bei R. Simon citing R. Baisus): Our houses are not ours (soldiers can come) to dwell with us. However, they cannot expel us. In the inn, [the tenant] can expel us. (We explained this like PNEI MEIR.)
