DOES ERUV DEPEND ON PARTNERSHIP? (Yerushalmi Perek 6 Halachah 7 Daf 41b)

מתני' האחין השותפין שהיו אוכלין על שולחן אביהן וישינין בבתיהן צריכין עירוב לכל אחד ואחד לפיכך אם שכח אחד מהן ולא עירב ביטל רשותו

(a)

(Mishnah): If brothers eat at their father's table and sleep in their own houses, they need an Eruv for each one. Therefore, if one of them forgot to be Me'arev, [he must be] Mevatel his Reshus [to permit the others];

אימתי בזמן שמוליכין את עירובן למקום אחד [דף מה עמוד א (עוז והדר)] אבל אם היה עירוב בא אצלן או שאין עמהן דיורין בחצר אינן צריכין לערב:

This is when they put their Eruv in another house [in the Chatzer]. If the rest of the Chatzer brought their Eruv to the father's house, or if no one else lives in the Chatzer, they need not be Me'arev.

(Gemara) Question: Where is [a person's] primary Dirah?

ר' יונה אמר אתפלגון רב ושמואל חד אמר במקום פיתן וחד אמר במקום שינה ולא ידעין מאן אמר דא ומאן אמר דא

Answer (R. Yonah): Rav and Shmuel argued about this. One of them said that it is the place of his bread, and one said that it is the place where he sleeps. We do not know who said this and who said this.

מן מה דתני שמואל (למעלה מי' שבות) [צ''ל האחין שאוכלין על שולחן אביהן וישנין בבתיהן אין צריכין אלא עירוב אחד - שערי תורת ארץ ישראל] הוי דו אמר במקום פיתן.

Inference: Since Shmuel said that brothers who eat at their father's table and sleep in their own houses, they need only one Eruv, this shows that he holds that [his primary Dirah] is the place where he sleeps.

Question (against Shmuel - Mishnah): Brothers who eat [at their father's table and sleep in their own houses, they need an Eruv for each one].

רב חייה בר אשי בשם רב במקבלי פרס מאביהן היא מתניתא.

Answer (R. Chiya bar Ashi citing Rav): The Mishnah discusses brothers who receive food from their father [and sometimes eat in their own houses].

מ''מ אינן שותפין במה שהן אוכלין

Question: Why (Mipnei Mah) are they not partners in what they eat? (Why would their father not invite them to eat with him?)

אמר רבי בא אסברי רבי שמואל שאין אביהן זכה להן אלא במה שהן אוכלין בלבד.

Answer (R. Ba): R. Shmuel explained to me that their father is not Mezakeh the food for them, just [he sends to them] what they eat (lest it seem to them that they are partners, and they will not honor him. We explained this like MEICHAL HA'MAYIM.)

מעתה אפילו (אין - פני משה מוחקו) עירב בא אצלן

Question: If so, even if the Eruv comes to them [they should need to be Me'arev]!

עשו אותו כבית שמניחין בו את העירוב

Answer: They are considered like the house in which the Eruv is put.

שמואל אמר הוא ובניו ובני ביתו מערבין בככר אחד.

(Shmuel): A man and his children and household may be Me'arev with one loaf.

מה ופליג תמן הוא אמר במקום פיתן והכא אמר הכין

Question: Does [Shmuel] contradict himself?! There, he said that [Dirah] depends on the place of his bread, and here he says so?! (Surely, his household sleeps with him. Shmuel's Chidush must be that they are Yotzei with one loaf, even if they eat by themselves!)

פתר לה כשהיו שנים שותפין בו ותייא כיי דמר ר' אחיא ב''ר זעירא מערבין בחצי ככר.

Answer: The case is, two [of his children or household] were partners in it. It is like R. Achiya bar R. Ze'ira said, that we may be Me'arev with a half-loaf;

ותנינן אפילו מאפה סאה והיא פרוסה אין מערבין בה ותימר הכין

Question: A Mishnah (7:10) teaches that even if one bakes a Se'ah (12 liters, and removed part, so) it is an incomplete loaf, one may not be Me'arev with it, and you say so (that we may be Me'arev with a half-loaf)?!

פתר לה כשהיו שנים שותפין בו

Answer: The case is, [it is a complete loaf. It is called a half-loaf because] two were partners in it.

בית שמניחין בו את העירוב.

(m)

The house in which they put the Eruv [Amora'im argue about this, like the Gemara will say];

ר' יעקב בר אחא דמכת אימיה [דף מה עמוד ב (עוז והדר)] א''ר יסא לר' אבהו תני לה ותנא לה בית שמאי אוסרין ובית הלל מתירין.

R. Yakov bar Acha's mother died [and he had not been Me'arev. The Eruv was in his house.] R. Yosa told R. Avahu "teach'' [the Beraisa about this, and R. Yakov will know the Halachah. One may not tell him directly, for a mourner may not learn Torah.] He taught "Beis Shamai forbid, and Beis Hillel permit.''

רבי המנונא אמר בית שמניחין בו את העירוב אינו צריך כלום

(n)

(R. Hamnuna): (Through Eruv, it is as if one lives there.) The house in which they put the Eruv does not need anything [for they truly live there]!

ר' חסדאי אמר נעשו כשותף

(R. Chisdai): They become like a partner (automatically, food in the house is considered like part of the Eruv. Eruv works due to Kinyan.)

Rebuttal (R. Hamnuna): The words of Rabanan refute you;

דאיתפלגון מבוי שצידו אחד עכו''ם וצידו אחד ישראל רב חונה בשם רב אמר עירבו דרך פתחים העכו''ם אוסר עליהן

There was an argument about a Mavuy that one side has a Nochri and one side has Yisraelim. Rav Huna citing Rav said that if they were Me'arev through their openings to the Mavuy, the Nochri forbids them. (Even though Chachamim did not decree about an individual who lives with Nochrim, for this, Eruv does not make them like an individual);

אבא בר חונה בשם ר' יוחנן אפי' עירבו דרך החלונות [דף מב עמוד ב] אין העכו''ם אוסר עליהן

(Aba bar Chunah citing R. Yochanan): Even if they were Me'arev through their windows [between their houses], the Nochri does not forbid them.

אין תימר (בשותף) [צ''ל כשותף - פני משה] הוא ייסר.

If you will say that [through Eruv, he is] like a partner, [this is not like an individual who lives with Nochrim. The Nochri] should forbid [according to R. Yochanan! And Rav said only regarding this that, Eruv does not make them like an individual. He could agree that for other laws, Eruv makes it is as if they all live there!]

רבי יעקב בר אחא רבי יסא בשם רבי יוחנן בני המבוי שנתנו עירובן בשני מקומות אם מבלי מקום הרי זה מותר אם בשביל לחלוק עירובן אסור

(q)

(R. Yakov bar Acha citing R. Yosa citing R. Yochanan): If Bnei Mavuy put their Eruv in two places, if [they did do] because there was not room for it in one place, it is permitted. If it was in order to divide their Eruv, it is forbidden.

ר' יוסה מיקל לה הוא דאמרה עיגול הוא דרב.

R. Yosah disgraced one who said "my loaf is big'' (this shows adamancy to get back the same loaf. This is not a proper partnership!)

ר' יוסי בי ר' בון מברך עלוי בלילי שובתא לומר שנעשה בו מצוה.

(s)

R. Yosi bei R. Bun would bless on [the Eruv loaf] on Shabbos night, to show that since a Mitzvah was done with it [he will do another Mitzvah with it].

תמן תנינן מערבין בבית ישן מפני דרכי שלום

(t)

(Mishnah): We are Me'arev in the old house [where they used to be Me'arev], due to Darchei Shalom.

(R. Avun): The Mishnah discusses an old resident. (We are adamant to be Me'arev in the old house only if the same resident is there, lest people say that he stole the Eruv.)
