1)

MATTERS THAT RESEMBLE HOTZA'AH FROM RESHUS TO RESHUS (Yerushalmi Perek 10 Halachah 5 Daf 60b)

מתני' עומד אדם ברשות היחיד ומטלטל ברשות הרבים ברשות הרבים ומטלטל ברשות היחיד [דף סא עמוד א] ובלבד שלא יוציא חוץ לארבע אמות

(a)

(Mishnah): One may stand in Reshus ha'Yachid and move things in Reshus ha'Rabim, or vice-versa, as long as he is not Motzi (take something in Reshus ha'Rabim) outside of four Amos.

לא יעמוד אדם ברשות היחיד וישתין ברשות הרבים ברשות הרבים וישתין ברשות היחיד וכן לא ירוק

(b)

One may not stand in Reshus ha'Yachid and urinate to Reshus ha'Rabim, or from Reshus ha'Rabim to Reshus ha'Yachid. Similarly, one may not spit from Reshus to Reshus;

רבי יהודה אומר אף מי שנתלש רוקו מפיו לא יהלך ד''א עד שירוק:

R. Yehudah says, once saliva is gathered in his mouth, he may not walk four Amos [in Reshus ha'Rabim] before spitting it out.

גמ' לא סוף דבר עומד ברשות היחיד ומטלטל ברשות הרבים ברשות הרבים ומטלטל ברשות היחיד ובלבד שלא יוציא חוץ לד''א.

(d)

(Gemara): This is not unanimous, that one may stand in Reshus ha'Yachid and move things in Reshus ha'Rabim, or vice-versa, as long as he is not Motzi outside of four Amos.

אמר רב מתני' אמרה כן לא יעמוד אדם ברשות היחיד ויפתח ברשות הרבים ברשות הרבים ויפתח ברשות היחיד אלא אם כן (הכניס) ועשה לו מחיצה גבוהה עשרה טפחים דברי רבי מאיר.

Source (Rav): A Mishnah (below, 9) says so (that it is not unanimous). One may not stand in Reshus ha'Yachid and unlock in Reshus ha'Rabim, or stand in Reshus ha'Rabim and unlock in Reshus ha'Yachid, unless he made a Mechitzah 10 Tefachim tall. R. Meir says so. (We explained this like PNEI MOSHE.)

(Rav and R. Yochanan): [R. Yehudah] discusses phlegm [but not regular saliva].

דלא כן ר' יודה כדעתיה דאמר משקה טופח חיבור.

(g)

Support: If you would not say so, R. Yehudah [would contradict] what he said elsewhere, that Mashkeh Tofe'ach (wet enough to wet something else) is connected. (Regular saliva in the mouth is not considered detached.)

Not only [is it forbidden] to stand in Reshus ha'Yachid and urinate to Reshus ha'Rabim - rather, even if he stands in Reshus ha'Rabim urinates in Reshus ha'Rabim and it flows down to Reshus ha'Yachid, it is forbidden.

אמר רבי יוסי בי רבי בון לא סוף דבר עומד ברשות הרבים ומשתין ברשות היחיד אלא אפילו עומד ברשות היחיד ומשתין ברשות היחיד ומתגלגלין ויורדין לרשות הרבים אסור.

(R. Yosi bei R. Bun): Not only [is it forbidden] to stand in Reshus ha'Rabim and urinate to Reshus ha'Yachid - rather, even if he stands in Reshus ha'Yachid and urinates in Reshus ha'Yachid and it flows down to Reshus ha'Rabim, it is forbidden.

[דף סו עמוד א (עוז והדר)] אמר ר' יסא הדא אמרה סילון העומד ברשות הרבים גבוה עשרה ורחב ארבעה אין שופכין לתוכו מים שמתגלגלין ויורדין:

Inference (R. Yosa): This teaches that a pipe standing in Reshus ha'Rabim, 10 tall and four wide (it is Reshus ha'Yachid), one may not pour into it water that will flow and descend [to Reshus ha'Rabim].

DRINKING IN OR FROM ANOTHER RESHUS (Yerushalmi Perek 10 Halachah 6 Daf 61a)

מתני' לא יעמוד אדם ברשות היחיד וישתה ברשות הרבים ברשות הרבים וישתה ברשות היחיד אלא אם כן הכניס ראשו ורובו למקום שהוא שותה

(a)

(Mishnah): One may not stand in Reshus ha'Yachid and [stick his mouth out and] drink in Reshus ha'Rabim, or vice-versa [lest he bring the cup into the Reshus in which he stands, for which he would be liable], unless Rosho v'Rubo are in the same Reshus that he drinks from;

וכן בגת

(b)

The same applies to a winepress.

קולט אדם מן המזחילה למטה מעשרה טפחים

(c)

One may be Kolet (catch in mid-air) water dripping from a gutter pipe within 10 Tefachim of the ground;

מן הצינור ומכל מקום שותה:

(d)

One may drink from a Tzinor (a pipe that sticks out from the roof) in any case (even Metzaref, i.e. his mouth is next to it).

(e)

(Gemara): Granted, One may not stand in Reshus ha'Rabim and [stick his head out and] drink in Reshus ha'Yachid (his mouth is in Reshus ha'Yachid, even if it is above 10).

ברשות (הרבים וישתה ברשות היחיד) [צ''ל היחיד וישתה ברשות הרבים - מיכל המים] אין פיו למעלה מעשרה טפחים

(f)

Question: [Why is it forbidden to stand] in Reshus ha'Yachid and drink in Reshus ha'Rabim? Is his mouth not above 10 Tefachim [which is Mekom Petur]?! (We explained this like MEICHAL HA'MAYIM.)

שנייא היא שמתגלגלין ויורדין.

Answer: Here is different, for [the water] descends [into his innards, which are below 10].

Note: An average person is three Amos tall (some say that this is until the shoulder, and some say until the head). One's belt is above half his height. The stomach is above 10! Perhaps since often it is below 10, e.g. a short man, a young man (e.g. 13 years old), a woman, one who is sitting... it is reasonable to forbid in every case.

תני גמל שראשו ורובו מבפנים מלעיטין אותו מבפנים מבחוץ מלעיטין אותו מבחוץ

(h)

(Beraisa): If Rosho v'Rubo (the head and majority) of a camel are inside, one may force-feed it inside. If [Rosho v'Rubo] are outside, one may force-feed it outside.

ניחא מבפנים מלעיטין אותו מבפנים מבחוץ מלעיטין אותו מבחוץ אין פיו [דף סא עמוד ב] למעלה מעשרה טפחים.

(i)

Question: Granted, when [Rosho v'Rubo] are inside, one may force-feed it [only] inside. When they are outside, why may one force-feed it [only] outside? Is its mouth not above 10 Tefachim (Mekom Petur)?!

רבי יוסי בי רבי בון מחלפה שמועתיה

(j)

Answer: R. Yosi bei R. Bun reverses the teaching. (If Rosho v'Rubo are inside, one may force-feed it food inside when he stands outside. We are not concerned lest he take the food to where he is. If Rosho v'Rubo are outside, one may force-feed when he is inside.)

[צ''ל א''ר חייה וכן בגת לעניין מעשר - פני מאיר מוחקו לקמן וגורסו כאן]

(k)

(R. Chiyah): "The same applies to a winepress'' [in our Mishnah] refers to Ma'aser. (Just like one may not drink in a different Reshus than he stands in, unless he enters Rosho v'Rubo there, one may not drink from a winepress without tithing unless he enters Rosho v'Rubo there. We explained this like PNEI MEIR.)

לא כן אמר רבי יעקב בר אחא בשם ר' חנינה שכל שלשה ושלשה שהן סמוכין למחיצה כמחיצה.

Question: (Why does our Mishnah permit to be Kolet from a Mazchilah, i.e. gutter-pipe, below 10? Presumably, it is less than three wide. If so, it is Reshus ha'Yachid, like the roof!) Did not R. Yakov bar Acha say in the name of R. Chaninah that within three Tefachim of a Mechitzah are like the Mechitzah?!

תיפתר ביוצא חוץ לשלשה שאין בו רוחב ארבעה.

(m)

Answer: The case is, it is more than three from the roof, but it is not four wide.

Note: There is an implied question. Even if it were four by four, it is not Reshus ha'Yachid, for goats can penetrate underneath!

נעץ קנה והקיפו מחיצה וזרק מרשות הרבים לתוכו. [דף סו עמוד ב (עוז והדר)] רבי יצחק בן אלעזר אומר כמחלוקת

Answer: If one inserted a stick and it is surrounded by walls (it is in Reshus ha'Yachid) and he threw from Reshus ha'Rabim to it - R. Yitzchak ben Elazar says that this depends on the argument [of R. Yosi b'Ribi Yehudah and Rabanan. R. Yosi b'Ribi Yehudah holds that it is Reshus ha'Yachid even if goats can penetrate underneath.]

התיב רבי יודן והתנינן היתה עומדת בראש הגג וזרקו לה כיון שהגיע לאויר הגג הרי זו מגרשת.

Question (R. Yudan - Mishnah): If [a woman] was standing on top of the roof, and [her husband] threw [a Get] to her, once it reaches the airspace of the roof, she is divorced [according to everyone. Even Rabanan agree that the air above Reshus ha'Yachid is like Reshus ha'Yachid!]

אמר רבי אליעזר מתני' אמרה בגג שיש לו מעקה והוא שירד לאויר מעקה

Answer (R. Eliezer): One Mishnah discusses a roof with a railing around it. [She is divorced] after [the Get] descended to the airspace within the railing;

ושאין לו מעקה שירד לאויר שלשה שהן סמוכין לגג שכל שלשה הסמוכין לגג כגג הן

And if it does not have a railing, it must descend within three [Tefachim] of the roof, for within three of the roof are like the roof. (However, above the railing and above three, Rabanan say that she is not divorced.)

Note: There is an implied question. If the Mazchilah is not four wide, why is it permitted only below 10?

Answer #1 (Rav Yehudah): [Our Mishnah] is like R. Meir, who says "you view the wall as if it were carved out'' (to complete the pipe to a Shi'ur of four by four. Above 10 it is Reshus ha'Yachid, so we forbid Kolet, for it is like Motzi from Reshus ha'Yachid to Reshus ha'Rabim.)

ר' יעקב בר אחא בשם ר' לעזר דברי הכל במשתפע עשרה טפחים מתוך שלשה.

Answer #2 (R. Yakov bar Acha citing R. Lazar): It is like everyone. The case is, [the Mazchilah] slopes 10 [Tefachim] amidst three [Amos, near the ground, and it is four wide, so it is Reshus ha'Yachid].

ר' יוסי בעי אם במשתפע עשרה טפחים מתוך שלשה כגג הן.

(s)

Objection (R. Yosi): If it slopes 10 amidst three, it is like the roof! (Why is it permitted below 10?)

מה נן תמן שאינו צריך ניחא את אמר עד שיניח כאן שצריך ניחא לא כל שכן

(t)

Answer: There (regarding Get), which need not rest (like we find regarding a Get thrown over the roof, if it is thrown onto an incline, it is not valid) until it rests. Here (Shabbos) that we require Hanachah, all the more so [we permit water falling from a Mazchilah, for it did not have Hanachah]!

א''ר חנינא קומי ר' מנא מ''מ לא נח

(u)

Question (R. Chaninah, to R. Mana): [If so, also above 10 should be permitted,] for there was no Hanachah!

א''ל מכיון (שאין בו רוחב ד' אפילו נח כאילו לא) [צ''ל שיש בו רוחב ד' אפילו לא נח כאילו - מיכל המים] נח:

Answer (R. Mana): Since it is four wide, even if there was no Hanachah, [we are stringent to consider it] as if there was Hanachah. (We explained the entire Sugya like MEICHAL HA'MAYIM.)

DRAWING FROM A PIT THROUGH A WINDOW (Yerushalmi Perek 10 Halachah 7 Daf 61b)

מתני' בור בר''ה וחלייתו גבוה עשרה טפחים חלון שעל גביו ממלין ממנו בשבת

(a)

(Mishnah): If a pit is in Reshus ha'Rabim and its Chulyah is 10 Tefachim tall, a window over it may draw water from it on Shabbos;

אשפות ברשות הרבים [דף סב עמוד א] גבוה עשרה טפחים חלון שעל גבה שופכין לתוכה מים בשבת:

(b)

If a wasteheap in Reshus ha'Rabim is 10 Tefachim tall, a window over it may spill wastewater onto it on Shabbos.

[דף סז עמוד א (עוז והדר)] גמ' אין את רואה עמוק כגבוה.

(c)

(Gemara) Question: Do you not view depth like height?! (The pit should be Reshus ha'Yachid even if its Chulyah is not 10 tall!)

שאין בפיו רוחב ארבעה.

(d)

Answer: The case is, the opening of the pit is not four wide [so the Chulyah must be 10 to complete the Shi'ur of four].

עד כדון בסתום היה מופלג

(e)

Question: This is if [the window] is very close to the pit. If it is distanced [four Tefachim, what is the law]?

רב ושמואל חד אמר נותן נסר וחד אמר נועץ קנה ולא ידעינן מאן מר דא ומאן מר דא

(f)

Answer: Rav and Shmuel - one of them said that he puts a plank [from the window to the pit, so it will all be airspace above Reshus ha'Yachid], and one said that he inserts a stick [in between, to stop people from passing through]. We do not know who said who said this.

מן מה דתני שמואל למעלה מעשרה שבות הוא דין אמר נותן נסר.

(g)

Inference: Since Shmuel taught that above 10 [over Reshus ha'Rabim, carrying there] is Shevus, this shows that he said that he puts a plank.

היו שנים תרין אמורין חד אמר עשרה וחורן אמר ארבעה

(h)

If there were two windows [distanced from the pit], two Amora'im [argued about this]. One said [that each makes a Mechitzah] 10 tall [from his window to the pit], and the other said that he [makes a plank] four [wide].

מתיב מאן דמר עשרה למאן דמר ארבע לא נמצאו שתי רשויות משתמשות ברשות אחת

(i)

Question (the one who said 10, against the one who said four): [According to you,] does it not turn out that two Reshuyos use one Reshus?!

אמר ליה רה''ר מבטלת:

Answer: Reshus ha'Rabim [separates them, and] prevents [them from being considered two Reshuyos using one Reshus - PNEI MEIR. Perhaps the text should say "Mavdeles''- PF.]
