ERUVIN 96-100 - Dedicated in memory of Max (Meir Menachem ben Shlomo ha'Levi) Turkel, by his children Eddie and Lawrence and his wife Jean Turkel/Rafalowicz. Max was a warm and loving husband and father and is missed dearly by his family and friends. His Yahrzeit is 5 Teves.

LAWS OF TREES AND DOORS (Yerushalmi Perek 10 Halachah 8 Daf 62a)

מתני' אילן שהוא מיסב על הארץ אם אין נופו גבוה מן הארץ שלשה טפחים מטלטלין תחתיו

(a)

(Mishnah): If the foliage of a tree hangs within three Tefachim of the ground, one may carry under it;

שרשיו גבוהין מהארץ שלשה טפחים לא ישב עליהן

(b)

If its Sharashim (roots, or branches coming out of the trunk) are above three Tefachim, one may not sit on them.

הדלת שבמוקצה והחדקין שבפירצה [דף סז עמוד ב (עוז והדר)] ומחצלת אין נועלין בהן אלא אם כן היו גבוהין מן הארץ:

. A door to Rachbah (a Chatzer in back of houses), bundles of thorns [put] in a breach in a wall [to seal it], and a [reed] mattress - one may not close [an opening with them, for it looks like building] unless they are [held] above the ground.

גמ' ובלבד שלא יהו בו יותר מבית סאתים (ולא יהו) [צ''ל ויהו - קרבן העדה] מחיצות גבוהות עשרה ולא יהו פרצות יותר מעשר ולא יהא עומד כנגד עומד ופרוץ כנגד פרוץ.

(d)

(Gemara): [One may carry under the foliage of a tree] as long as it is not more than Beis Sa'atayim, and the walls [created through the foliage] are 10 high, and there are not breaches more than 10 [Amos], and there is not Omed (standing wall) opposite Omed and Parutz (breach) opposite Parutz.

ר' אחא בשם רב אסור לתלוש שרשי זמורה בשבת. היא שרשי אילן היא שרשי כרוב. בגבוהין שלשה אבל אין גבוהין ג' כארץ הם.

(R. Acha citing Rav): One may not detach root branches on Shabbos. Tree roots and cabbage roots have the same law, if they are three high. If they are not three high, they are like the ground.

מתני' [דף סב עמוד ב] בשאין להן צירין אבל יש להן צירין הדא היא דתני דלת (גודרת מחצלת גודרת קנקילון גודר) [צ''ל גוררת מחצלת גוררת קנקילון גורר - קרבן העדה] פותח ונועל בשבת ואין צריך לומר ביום טוב.

Our Mishnah is when [the doors] do not have hinge-pins. (To open it, one rests it on the ground.) If they have hinge-pins (they always stand, and swing open or closed), this is like a Beraisa teaches, [a hanging] door that drags, mat that drags, or Kankilon (a perforated Kli for fumigating Kelim) that drags, one may open and close them on Shabbos, and there is no need to say so on Yom Tov.

מחצלת הקשורה ותלויה בשבת פותח ונועל בשבת ואין צורך לומר ביום טוב:

1. A mat that is tied and hangs [above the ground], one may open and close it on Shabbos, and there is no need to say so on Yom Tov.
