(Mishnah): [If she was taken] for a capital offense, she is forbidden.

(R. Yudan brei d'Rav Chama of Kefar Tachmin citing Chizkiyah): This is if she had a final verdict for execution.

(R. Yochanan): It is even if she did not have a final verdict for execution.

(In the name of R. Yochanan): The wife of a bandit is like the bandit. (If she was taken due to her husband, if her husband was liable to be killed, she is forbidden.)

Question: What is considered a siege?

Answer (R. Ba citing R. Chiya bar Ashi): E.g. there are bells, chains, dogs, geese, chickens (so it will be heard if someone flees) and soldiers surrounding the city.

(R. Ba citing R. Chama bar Ashi): A case occurred, and a blind person fled from there [and all the women were permitted. Each could say that also she fled.]

If there was one breach [from which people can flee], it saves (permits) all of them.

Question: If there was a hiding place [where one woman could hide, and they would not suspect that anyone is there, what is the law? Can each say that she his there? Or, since it is impossible that all hid there, all are forbidden?]

(R. Ze'irah citing R. Ba bar Zavda citing R. Yitzchak bar Chakulah citing R. Yudan Nesi'ah): This applies only to a siege of that kingdom, but a siege of another kingdom, they are like bandits. (They fear the kingdom they conquered; they do not defile women.)

Question: Is even a minor [believed to testify that a woman was not defiled]?

Answer (R. Imi citing R. Yehoshua ben Levi): Even a minor [is believed]. Even a relative [is believed].

Question: Is even a minor and [he is also] a relative [believed? Or, did R. Yehoshua ben Levi permit only a minor stranger, and an adult relative?]

Answer: We learn from the following. Chananyah Kartisiyah was captured - he, his [minor] sons and his wife. They came in front of R. Chanina, and he did not accept (their testimony about his wife). They came in front of R. Yehoshua ben Levi, and he accepted them. This teaches that even a minor and [he is also] a relative [is believed].

R. Chiya bar Yosef sent for his wife [to come to him]. He said, three Talmidim should accompany her, so if one distances for his needs (to excrete), she will be alone with two.

Question (Mishnah): We give to a man [taking his wife to the Mikdash to make her drink Mei Sotah] two Chachamim, lest he have Bi'ah with her on the way (and then, the water will not test her. Also here, two should suffice!)

Answer (R. Avin): [There are two Chachamim] and her husband - there are three in all.

Even [though Chachamim forbade R. Zecharyah ben ha'Katzav's wife to him,] he rented a house for her and fed her and was not secluded with her, only in front of her children, and applied to himself "Yagati b'Anchasi u'Menuchah Lo Matzasi" (he toiled to guard his wife so he could testify about her, but it did not help).
