TOSFOS DH MAH MO'ADO HA'AMUR B'TAMID DOCHEH ES HA'SHABBOS

(SUMMARY: Tosfos discusses the various ways of learning this, and concludes that it is a Machlokes between the various Sugyos.)

(a)

Source: Later on, the Gemara will learn it from "Al Olas ha'Tamid".

(b)

Question #1: Our Sugya does not Darshen it from the implication of the word "Mo'ado" ...

(c)

Question #2: Similarly, the Halachah that Pesach overrides Tum'ah we will learn later from "Ish" - 'a man is pushed away, but not a Tzibur; and regarding the Tamid, we learn it from the Gezeirah-Shavah of "Mo'ado" "Mo'ado" ...

(d)

Question #3: Whereas in Perek Keitzad Tzolin (later on Daf 77.) the Gemara seems to learn it from the implication of "Mo'ado"

1.

Source: As we learned there in a Beraisa - 'Why does the Pasuk say 'And Moshe told them the festivals of Hash-m"?

2.

Question #3 (cont.): Because the only two places in the Torah where the Torah writes "Mo'ado" are by Pesach and by Tamid; "Mo'ado" - 'even on Shabbos', "Mo'ado" - 'even be'Tum'ah'. And how do we know that this applies to other Korbanos?'

3.

Question #3 (concl.): Implying that the Gemara learns it from the implication of "Mo'ado"?

(e)

Question #4: Moreover, the Gemara there explains that we need them both - because had the Torah written it only by Tamid, this is because it is more common and it is completely burned, but Pesach not. Whereas had it written it only by Pesach, that is because it is subject to Kareis ...".

1.

Question #4 (cont.): Now if we would learn it from the Gezeirah-Shavah (of "Mo'ado" "Mo'ado"), why would the Tzerichusa be necessary, seeing as we need "Mo'ado" of Tamid because of Tum'ah, and of Pesach, because of Shabbos?

2.

Question #4 (concl.): Clearly, the Gemara learns it from the implication of "Mo'ado".

(f)

Answer: It must therefore be a Machlokes Tana'im.

(g)

Extension of Answer: Furthermore, in Perek Rebbi Yishmael (Menachos Daf 72.), the Gemara learns that the Sh'tei ha'Lechem (See Hagahos ve'Tziyunim) override Shabbos from "Takriv" - "Takriv", 'even on Shabbos, "Takriv", 'even be'Tum'ah'.

1.

Extension of Answer (cont.): Whereas according to our Sugya, the Gemara could just as well learn it from "Mo'ado" from Pesach and Tamid, or from the implication, like it does in 'Keitzad Tzolin'.

2)

TOSFOS DH TOCHAVLO B'TZIMRO

(SUMMARY: Tosfos explains why the Isur of R'shus ha'Rabim implied in our Sugya does not clash with the Sugya in Zevachim.)

(a)

Question: But surely one needs a K'li Shareis, as we learned in Perek Dam Chatas (Zevachim Daf 97:) from "And he took the knife (written by the Akeidah)"?

(b)

Answer: It speaks where they declared the knives Hekdesh then.

(c)

Observation: The Sugya implies that the Isur of (carrying in the) 'R'shus ha'Rabim applies in Yerushalayim.

(d)

Question: The Gemara in Eruvin however (Daf 6.) states that if the gates of Yerushalayim would not be shut at night, one would be Chayav for carrying in the R'shus ha'Rabim?

1.

Question (cont.): And 'shut' is La'v Davka - If they are fit to be shut it will suffice.

(e)

Answer: The Ri answers that the Gemara here is speaking after the Greeks breached the walls.

1.

Precedent: And the Gemara in the last Perek of Eruvin gives the same answer, though with respect of a different question.

3)

TOSFOS DH MAH L'TAMID SHE'KEIN TADIR

(SUMMARY: Tosfos offers an answer to the Gemara's Kashya.)

(a)

Question: Why can we not learn that Pesach overrides Shabbos from Tamid and Milah, or from Sh'tei ha'Lechem and one of the two?

66b----------------------------------------66b

4)

TOSFOS DH V'HA KA'AVID AVODAH B'KODSHIM K'HILLEL

(SUMMARY: Tosfos cites a Yerushalmi, which explains it differently.)

(a)

Yerushalmi: The Yerushalmi explains it differently. The Gemara there says that any Avodah which is for the benefit of the Korban is not subject to Me'ilah.

1.

Source: An he learns it from Parah Adumah - in the same way as there, where any work that is for the benefit of the cow is not considered an Avodah to render it Pasul.

2.

Source (cont.): And the Gemara cites the Mishnah in Maseches Parah (Perek 2, Mishnah 3) 'that if one rides on it, or holds on to its tail whilst crossing the river, it is Pasul.

3.

Source (concl.): Whereas if one ties it reins on to it, makes a shoe for it so it should not slip or spreads over it a cloak because of the flies, it is Kasher. This is the rule; Whatever is for its needs, it remains Kasher'.

5)

TOSFOS DH MEVI'AH K'SHE'HI CHULIN LA'AZAERAH

(SUMMARY: Tosfos reconciles this Sugya with Sugyos in Bava Basra and Chulin.)

(a)

Implied Question #1: In Perek ha'Mocher es ha'Sefinah (Bava Basra, Daf 81:) in connection with someone who purchases two trees, the Gemara asks "Let us suspect that perhaps it is not Bikurim, in which case he isbringing Chulin into the Azarah'?

(b)

) Implied Question #2: And in 'ha'Zero'a' (Chulin Daf 130.),too, the Gemara states that the reason there is 'Because the Torah writes "Zeh"; otherwise, we would have thought that Chulin is subject to the Din of 'Chazeh ve'Shok. What would one then do? Wave it? But the Torah writes 'Lifnei Hash-m?" Whereas if it is inside the Azarah, then one is guilty of bringing Chulin into the Azarah'?

(c)

Answer: There it is certainly prohibited, since one waves it like one does a Korban Here on the other hand, where one merely brings a Chulin lamb into the Azarah, without doing to it anything that one would do to Korbanos, that would appear that one is offering Chulin to Hash-m, it is permitted.

(d)

Precedent: As we find in 'ha'Kometz Rabah' (Menachos, Daf 21:) where the Gemara records how 'They used to eat Chulin in the Azarah, in order to eat Menachos 'al ha'Sova' (as a form of dessert).

6)

TOSFOS DH MECHAMER KI'L'ACHAR YAD HU

(SUMMARY: Tosfos suggests an answer to the Gemara's Kashya.)

(a)

Alternative Answer: The Gemara may well have answered that 'When the animal is already walking, he places it on it, and when it has stopped, he takes it off.

(b)

Source: Which the Gemara at the beginning of' 'Mi she'Hichshich' (Shabbos, Dafn153.) permits.

7)

TOSFOS DH KI'L'ACHAR YAD NAMI ASUR MI'D'RABBANAN

(SUMMARY: Tosfos suggests an alternative Kashya.)

(a)

Alternative Question: The Gemara could have asked from the prohibition of using a living animal, which is also Asur mi'de'Rabbanan.

8)

TOSFOS DH HANACH L'HU L'YISRAEL

(SUMMARY: Tosfos explains why Chazal did not prohibit being Makdish a Pesach on Shabbos even though he could have done so before Shabbos.)

(a)

Question: But does our Mishnah not forbid a Sh'vus (an Isur de'Rabbanan, since it could have been done before Shabbos?

(b)

Answer: A Sh'vus concerning animals is more lenient than a Sh'vus concerning a person.

9)

TOSFOS DH V'EIN TZIBUR NIDACHIN

(SUMMARY: Tosfos reconciles this with the Gemara in Sanhedrin.)

(a)

Question: Here the Gemara precludes only the majority of Yisrael from "Ish", whereas in the first Perek of Sanhedrin (Daf 17:) the Gemara Darshens (in connection with Avodah-Zarah) "Vehotzeisa es ha'Ish ha'Hu" - 'Ish ve'Ishah Atah Motzi li'She'arecha, but not the entire city', and others there preclude an entire tribe?

(b)

Answer #1: It is different there, seeing as the Torah makes this distinction with regard to Ir ha'Nidachas.

(c)

Answer #2: Alternatively, "Ish ve'Ishah" is written a number of times in the Parshah there.

10)

TOSFOS DH ELA AMAR RESH LAKISH VI'SHALCHU MIN HA'MACHANEH

(SUMMARY: Tosfos queries Resh Lakish's answer from Rebbi Shimon later.)

(a)

Question: The Rashba asks that whereas Resh Lakish's answer goes well with Rebbi Yehudah, but according to Rebbi Shimon, who says later (on Daf 67.) that the Torah writes Zav, Tamei Meis and Metzora because their Dinim regarding being sent of the camp differs, from where will he learn that Pesach overrides Tum'ah?
