LAWS OF AN ANDROGINUS (Yerushalmi Perek 8 Halachah 6 Daf 50b)

ואין חלוקין על דברי רבי יודה.

(a)

Question: Do Chachamim argue with R. Yehudah (who says that a Tumtum who was torn and found to be a male does not do Chalitzah, since he is like a Seris)?

מן דאמר רבי יוסי בשם רבי הילא מייבמין את אשתו הדא אמרה (אין) חלוקין על דברי ר' יודה.

(b)

Answer: Since R. Yosi said in the name of R. Heila that we do Yibum to [the Tumtum's] wife, this shows that they argue with R. Yehudah. (We explained this like PNEI MEIR.)

קידש (אינן - קרבן העדה מוחקו) חוששין לקידושיו. נתקדש חוששין לקידושיו נבעל נפסל מן התרומה כנשים

If an Androginus Kohen was Mekadesh [a woman], we are concerned for his Kidushin. If a man was Mekadesh [an Androginus], we are concerned for his Kidushin. If a [Pasul man] had Bi'ah with [an Androginus Kohen, the latter] is disqualified from Terumah, like a woman. (He is a Safek male, Safek female, so we are stringent in every case.)

וקשיא ר' ניחא ברבי סבא ר' יונה בשם רב המנונה אפי' מין במינו כל שהוא.

(d)

Question (R. Nicha b'Ribi Sava citing R. Yonah citing Rav Hamnuna): Is this even if his own type (another Androginus had Bi'ah with him) in any way (whether in the anus, or in his female genitals)?!

וקשיא אם זכר הוא אין זכר פוסל זכר. אם נקיבה היא אין נקיבה פוסלת נקיבה.

This is difficult! If [an Androginus] is a male, a male does not disqualify a male. If [an Androginus] is a female, a female does not disqualify a female (whatever they do to each other is not considered Bi'ah)!

צד זכרותו של זה פוסלת צד נקיבתו של זה.

Answer: (An Androginus is not a Safek male, Safek female. Rather, he has a male side and a female side.) The male side of [the Bo'el] disqualifies the female side [of the Niv'al. We explained this like HA'GAON RAV C. KANIEVSKY, SHLITA, MEICHAL HA'MAYIM.]

מאכיל את נשיו ואינו מאכיל את עבדיו.

[An Androginus who was Niv'al to a Pasul] feeds his wife [Terumah], but he does not feed his slaves;

מאכיל את נשיו מכח זכרותו. ואינו מאכיל את עבדיו. מכח זה וזה. נתחלל צד נקיבה שבו.

He feeds his wife due to his male side (it was not profaned). He does not feed his slaves, for [they eat] due to both (the entire body of their master), and his female side was profaned.

ר' יעקב בר זבדי בשם ר' אבהו בשם ר' יוחנן ובלבד ממקום זכרות.

(R. Yakov bar Zavid citing R. Avahu citing R. Yochanan): [R. Lazar says that one is stoned for Bi'ah with an Androginus, like with a man] only if he [had Bi'ah with him] in his male place (the anus, but not if it was in the female genitals).

ר' סימון בשם ריב"ל אפילו ממקום נקיבה.

(R. Simon citing Reish Lakish): It is even in the female genitals.

רבי יעקב בר זבדי בשם רבי אבהו חזר בה ריב"ל מן הדין קרייא [שם יח כב] ואת זכר לא תשכב משכבי אשה. את שיש לו שני משכבות (באשה) [נראה שצ"ל כאשה] ואי זה זה זה אנדרוגינס.

(R. Yakov bar Zavid citing R. Avahu): Reish Lakish retracted due to "v'Es Zachar Lo Sishkav Mishkevei Ishah" - [a man] who has two places of Bi'ah, like a woman. Who is this? It is an Androginus [and the verse obligates only for "Es Zachar", in his male place].
