עוד חילוק אחר דגבי דמאי קתני ושאר מעשר סמוך לו זה שעשיתי מעשר עשוי תרומת מעשר עליו

Difference #3 (between Vadai Tevel and Demai): Regarding Demai, it was taught "the rest of the Ma'aser is next to it. This that I made Ma'aser is Terumas Ma'aser on it";

פי' מדה אחת שאני עתיד להפריש למחר יהא מעשר ושאר מעשר דהיינו ט' יהא סמוך לו

Explanation: The one measure that I will separate tomorrow will be Ma'aser. The rest of the Ma'aser, i.e. nine (measures), are next to it.

אותה מדה שעשיתי תחילה מעשר יהא תרומת מעשר על הט'

The measure that I initially made Ma'aser will be Terumas Ma'aser on the nine.

ומפריש למחר אותה מדה של תרומת מעשר ושותה הכל ואפילו אותם התשעה שהן מעשר למאן דאמר מעשר ראשון מותר לזרים

Tomorrow he separates the one measure of Terumas Ma'aser and drinks everything [else], even the nine measures that are Ma'aser, according to the opinion that Ma'aser Rishon is permitted to Zarim.

ולרבי מאיר דאמר אסור לזרים אם הוא לוי שותהו

According to R. Meir, who forbids Ma'aser Rishon to Zarim, if he is a Levi, he may drink them.

אבל בודאי לא יועיל לו שהרי אינו יכול להפריש אותה מדה בשבת

ii.

This does not work for Vadai Tevel, for he may not separate the measure on Shabbos.

ובלא הפרשה אינו יכול לשתות אותם התשעה כדקתני אי אתה מודה שמא יבקע הנוד ונמצא שותה טבלים למפרע

Without separating [Terumas Ma'aser], he may not drink the nine, like it was taught "don't you agree, lest the flask break, and he drank Tevel retroactively?"

ואם כן אם היה שותה המעשר כל כמה דלא הופרש הוה ליה כבקיעת הנוד

Therefore, if he would drink the Ma'aser, as long as it (Terumas Ma'aser) was not separated, this is like lest the flask breaking!

אי נמי בודאי טבל הוא זקוק ליתן המעשר ללוי לקיים מצות נתינה

Difference #4: Regarding Vadai Tevel, he must give the Ma'aser to a Levi to fulfill the Mitzvah of giving it.

עוד יש חילוק דגבי דמאי קתני מעשר שני בצפונו או בדרומו וגבי כותים לא קתני אלא תשעה מעשר שני ואין קובע להם מקום

Difference #5: Regarding Demai, it was taught "Ma'aser Sheni is in the north or south. Regarding Kusim, it was taught only "nine are Ma'aser Sheni", and he does not specify a place for them.

והיינו טעמא דקביעת מקום הוי כמו הפרשה ובבין השמשות איירי כדקתני בתוספתא (דדמאי פ"ח) וקדש עליו היום

This is because specifying a place is like separation. We discuss Bein ha'Shemashos, like it says in the Tosefta "the day became Kodesh on him";

ובספק חשיכה מעשרין את הדמאי לא את הודאי

When it is Safek dark one may tithe Demai, but not Vadai Tevel.

ומהאי טעמא נמי לא קתני גבי כותים כדקתני התם ומחולל על המעות אלא ומיחל ושותה מיד

Difference #6: Also for this reason (because he could not specify a place), it was not taught regarding Kusim like it says there "it is redeemed on the coins", rather, "u'Meichal and he drinks immediately";

Explanation: "Meichal" means "he begins", or like R. Meshulam explained [that the text is] u'Meihal with a Hei. This refers to mixing, like the verse "Sav'ech Mahul ba'Mayim" (your drinks are mixed with water).

אבל לחלל אינו יכול כיון שלא קבע לו מקום כדתניא בתוספתא דמסכת מעשר שני [פ"ג]

However, he cannot redeem it, since he did not fix a place for it, like a Tosefta (Ma'aser Oni Sof Perek 3) teaches.

Citation (Tosefta): If one said 'the Ma'aser Sheni in this item will be redeemed on this coin", he did not fix a place;

Citation (ibid.): R. Shimon says, he was Korei Shem;

Citation (ibid.): Chachamim say, he must say "it is in the north or south."

The Tosefta brings an episode in which R. Shimon ben Gamliel, R. Yehudah and R. Yosi entered the house of a Ba'al ha'Bayis in Keziv, and he used to redeem like this (without fixing a place);

ואמרו לו צא ואכול מעותיך השכרת מעות איבדת נפשות

They told him "go consume your coins. (They are Chulin.) You saved money, but caused souls to perish [through eating Ma'aser Sheni outside Yerushalayim]."

Implied question: Perhaps he holds like R. Shimon, who says that he was Korei Shem!

Answer: We can say that R. Shimon discusses one who said "[the Ma'aser is] inside it." He considers this like Keri'as Shem;

דהוי כעין פלוגתייהו דפליגי במסכת תרומות (פ"ג משנה ה) ומייתי לה בפרק בכל מערבין (עירובין דף לז:)

Support: This is like the Tana'im argue in Terumos (3:5), and it is brought in Eruvin 37b;

האומר תרומת הכרי זה בתוכו רבי שמעון אומר קרא שם

Citation (Mishnah - R. Shimon): If one said "the Terumah for this stack is inside it", he was Korei Shem.

ומפרש התם דכי אמר בתוכו כאילו אמר באמצעיתו דקבע מקום

It explains there that when he said "inside", it is as if he said 'in its middle', which fixed a place.

Rashi's opinion: This is unlike Rashi, who says that "u'Meichal" means that he redeems.

Rebuttal #1: He cannot redeem, like I explained [because he could not specify a place].

Rebuttal #2: Also, if he would drink through redemption without separation, he would drink Tevel retroactively, like I explained above.

וכן משמע הלשון דקאמר שאני עתיד להפריש אלמא כולהו צריך סופו להפריש

Rebuttal #3: Also the words connote [unlike Rashi]. He says "that I will separate." This shows that he must separate all [of the tithes] in the end.

וליכא למימר דשאני עתיד להפריש לא קאי אלא אתרומה דאי הוה חיילא בלא הפרשה אם כן היתה מדמעת ואוסרת הכל

Suggestion: "That I will separate" refers only to Terumah, for if it would take effect without separation, it would forbid everything like a mixture of Terumah and Chulin [because it is amidst the Chulin and we are unsure where it is]!

אם כן מעשר ראשון נמי דפתיכא (גירסא בגליון) ביה תרומת מעשר

Rejection #1: If so, the same applies to Ma'aser Rishon, which has Terumas Ma'aser mixed in!

וליכא למימר דאתרומה ומעשר ראשון קאי ולא אמעשר שני

Suggestion: ["That I will separate"] refers only to Terumah and Ma'aser Rishon, but not to Ma'aser Sheni.

דמאיזה טעם הוה לן למימר הכי הא לא קתני אלא חדא זימנא שאני עתיד להפריש ואי קאי אתרי קאי אכולהו

Rejection #1: There is no reason to say so. It says only once "that I will separate." If it applies to two [of the tithes], it applies to all of them!

ועוד בתוספתא קתני עשרה הבאים אחריהם תשעה הבאים אחריהם משמע אחריהן מן החבית

Rejection #2 (of both suggestions): Also, the Tosefta says "10 [measures] that come after them... Nine [measures] that come after them." This connotes [what comes] after them from [out of] the barrel!

ומיהו ההיא ראיה דתוספתא ודמסכת תרומה יש לדחות דכיון דמזכיר סכום התרומה והמעשר חשיב קריאת שם טפי ולא בעינן קביעות מקום

Disclaimer #1: We can reject the proof from the Tosefta (f:5) and Maseches Terumos (i:1). Since he mentions the amount of Terumah and Ma'aser, this is considered more Keri'as Shem, and he need not fix a place.

Disclaimer #2 - Citation (Ma'aser Sheni 4:7) (Mishnah - R. Yosi): If one redeemed Ma'aser Sheni, but was not Korei Shem, this suffices.

Conclusion: However, the other proofs are difficult for Rashi.

ועוד דהך משנה גופא בעיא קביעות מקום מדקתני סיפא בצפונו או בדרומו.

Support: Also, this Mishnah itself (the two Lugim that I will separate...) requires fixing a place, for the Seifa says "in the north or south."

TOSFOS DH Asarah Ma'aser Rishon Tish'ah Ma'aser Sheni

תוספות ד"ה עשרה מעשר ראשון תשעה מעשר שני

(SUMMARY: Tosfos explains that 10 and nine are not exact.)

לאו דווקא שהרי כיון שכבר נטל מן הק' שני לוגין לתרומה אינו עולה י' שלימים למעשר ראשון ותשעה למעשר שני מן הנותרים

(a)

Explanation: This is not precise. Since he already took two Lugim from the 100 to be Terumah, he need not separate 10 full Lugim for Ma'aser, nor nine [full Lugim] for Ma'aser Sheni from what remains!

ואין לומר דחיישינן שמא הכותי תרם תרומה גדולה ולהכי אין למעט בשביל התרומה ממעשר ראשון וממעשר שני

(b)

Suggestion: We are concerned lest the Kusi already separated Terumah Gedolah. Therefore, one may not diminish the amount of Ma'aser Rishon and Ma'aser Sheni due to the Terumah;

וצריך לתקן עדיין אותם שני לוגין דשמא כבר הורמה התרומה ונמצא שהם זקוקים למעשר

He must still fix (tithe) the two Lugim, for perhaps Terumah was already separated, and Ma'aser must be separated from the two Lugim (they are still Chulin).

והמעשרות נמי צריך לחזור ולתקן דילמא הוה ליה מרבה במעשרות

Also the Ma'aseros must be fixed again, lest [the Kusi did not separate and Terumah, and] he (the Yisrael) gave too much Ma'aser!

אין לומר כן דאם תיקן הכותי תיקן כראוי ואם לא תיקן לא תיקן כלל כדפי' לעיל.

(c)

Rejection: This is wrong. If the Kusi fixed (Terumah), he fixed [everything] properly. If he did not, he did not fix at all, like I explained above.

Note: Perhaps Tosfos refers to what he wrote on 55b (DH ha'Loke'ach), that Kusim tithe properly what they themselves eat, but not what they sell to others. Why aren't we concerned lest he made one grape Terumah to exempt his entire harvest (he is not concerned for Chachamim's Shi'urim for Terumah Gedolah), but takes Ma'aser only from what he will eat? Alternatively, perhaps he expounds "Aser Ta'aser v'Achalta" to exempt a seller only regarding Ma'aser, but not regarding Terumah!

TOSFOS DH Divrei R. Meir

(a)

Inference: Here connotes that R. Meir holds that Yesh Breirah.

ובפ' יש בכור (בכורות דף מח.) אמר דסבירא ליה כרב אסי דאמר האחין שחלקו מחצה יורשים ומחצה לקוחות דמספקא ליה אי כלקוחות אי כיורשים

(b)

Question: In Bechoros 48a, we say that he holds like Rav Asi, who says that brothers who split [an inheritance] are considered half-heirs, and half-buyers, for he is unsure whether they are like buyers or like heirs;

אלמא מספקא ליה אי אית ברירה אי לא

Inference: He is unsure whether or not Yesh Breirah! (If Yesh Breirah, every brother received his proper share, so they are like heirs. If Ein Breirah, perhaps he did not receive his proper share. The division of the property is like a sale. Each brother "sold" his true share in exchange for whatever he received when they split up.)

ויש לחלק בין הכא שמתנה ומברר דבריו לההיא דהאחין שחלקו שאינן מתנין ומבררין כלום

(c)

Answer: We can distinguish between here, where he stipulates and clarifies his words, and the case of brothers who split, in which they do not stipulate and clarify anything.

ובהא מיתרצא דרבא מוקי התם ר' מאיר ור' יהודה כרב אסי ובפ' כל הגט (גיטין דף כה:) קאמר רבא דתרוייהו אית להו ברירה

Support #1: This answers for Rava, who establishes there R. Meir and R. Yehudah like Rav Asi, and in Gitin (25b) Rava said that both of them hold that Yesh Breirah.

וכן יש לתרץ דשמואל דאמר בפ' בתרא דביצה (דף לז:) דאפילו בדרבנן לית להו ברירה גבי שנים שלקחו חבית ובהמה בשותפות

Support #2: This answers also for Shmuel, who said in Beitzah (37b) that they hold that even mid'Rabanan, Ein Breirah, regarding two who bought a barrel or animal in partnership [regarding its Techum];

ובפרק מי שאחזו (גיטין דף עה:) אתקין שמואל בגיטא דשכיב מרע אם לא מתי לא יהא גט ואם מתי יהא גט ואם לא מתי וכו'

i.

In Gitin (75b), Shmuel enacted the text of a Get of a Shechiv Mera (dangerously sick person) "if I will not die [from this illness], this is not a Get. If I will die [from it], this is a Get. If I will not die..."

ולכי מיית הוי גיטא אלמא דאפילו בדאורייתא אית ליה ברירה

ii.

If he dies, it is a Get. This shows that even for Torah laws, he holds that Yesh Breirah!

דכי האי גוונא דייקינן בר"פ כל הגט (שם דף כה:) ופרש"י שם הטעם דחשיב ליה ברירה משום דאין זה כשאר תנאים שאדם מתנה בגט

Support #3: We infer like this in Gitin 25b. Rashi says that it is considered Breirah because it is unlike other Tenayim that one makes about a Get;

שבידו לקיימו כשהוא מתנה עליהם וכשנתקיים התנאי הוי גט למפרע דהתם לאו משום ברירה הוי גט

i.

Citation (Rashi): Other Tenayim are b'Yado (within his ability) to fulfill them. When he stipulates about them, and the Tenai is fulfilled, it is a Get retroactively. There, it is not due to Breirah that it is a Get;

אבל הכא דאין בידו ובשעת התנאי הוא ספק והתנאי מתקיים מאיליו אי לאו משום ברירה לא הוי גט עכ"ל

ii.

Citation (cont.): However, here it is not b'Yado, and at the time of the Tenai it is a Safek whether the Tenai will be fulfilled by itself. If not for Breirah, it is not a Get.

והא דפריך בפ' בכל מערבין (עירובין דף לז:) אלא מעתה היו לפניו שני רמונים של טבל ואמר אם ירדו גשמים היום יהא זה תרומה על זה [ואם לאו יהא זה תרומה על זה] הכי נמי דלא הוי תרומה

Implied question: In Eruvin (37b), we asked "if so, if there were two pomegranates of Tevel in front of him, and he said "if rain will fall today, this is Terumah on the other" [and if not, the other is Terumah on this], will we say that it is not Terumah?!

Inference: It was clear to the Gemara that it is Terumah!

Answer #1: This is according to the opinion that Yesh Breirah.

Answer #2: It is even according to the opinion that Ein Breirah. Since he stipulates between whether or not rain will fall, this is considered more [like a Tenai, and not Breirah].

והשתא לפי החילוק שחילקנו בין היכא שמברר דבריו להיכא דלא קאמר מידי ניחא נמי דשמואל דבההיא דחבית ובהמה לא קאמר מידי

Support #4 (for Answer (c) above): According to my distinction between when he clarifies his words, and when he does not say anything, also Shmuel is not difficult, for regarding the barrel and animal, he did not say anything.

(h)

Question: If so, what was the contradiction in R. Yochanan in Bava Kama (69b)?

דאית ליה ברירה בההיא דכל המתלקט ובההיא דהאחין שחלקו לית ליה ברירה

He holds that Yesh Breirah regarding [redeeming] "whatever [Revai] will be collected", but he holds that Ein Breirah regarding brothers who divide.

לישני דיש חילוק בין היכא שמברר דבריו כההיא דכל המתלקט

The Gemara should have answered that we distinguish between when he clarifies his words, e.g. "whatever will be collected" [and when he does not say anything]!

וחוזר בו הגמרא מתוך קושיא זו

(i)

Strengthening of question: Due to the contradiction, the Gemara retracted [and said that R. Yochanan holds that the text says "was gathered"]!

יש לומר משום דניחא ליה למימר לעולם כל הנלקט כדקתני במשנה וניחא ליה נמי למימר לא תיפוך

(j)

Answer #1: This is because we preferred to say "was gathered", like it says in the Mishnah, and to say that we do not switch the opinions.

ועוד כי הוה משני נמי הכי אכתי הוה קשה ליה מההיא דכל הגט (גיטין דף כה.) דדייקינן התם דרבי יוחנן לית ליה ברירה

(k)

Answer #2: Even if we would have answered [that we distinguish when he clarifies], it would still have been difficult from Gitin 25a, where we derive that R. Yochanan holds that Ein Breirah;

דאמר אף אחרון נמי אין פוסל

Citation (25a - R. Yochanan): Even the last case (Reuven told a scribe to write a Get for one of his wives, and later he will decide which one, if he gave the Get, it) does not disqualify her [from Kehunah, if he will die].

Even though there he clarifies his words and stipulates that he will use it to divorce whichever one he wants (he holds that Ein Breirah).

Implied question: When the Gemara says there why R. Yochanan needed to teach [that Ein Breirah] in two cases, it could have said that had he taught only about brothers who divided, one might have thought that this is because he did not clarify his words!

אלא בלאו הכי עביד צריכותא שפיר

Answer: In any case, the Gemara gave a good reason why he needed to teach both cases.

ועוד יש לתרץ ההיא דשמואל בענין אחר דבגיטין הדבר עומד להתברר שהרי או יחיה או ימות

Resolution #2 (for Shmuel - see (e)): Regarding Gitin, the matter is destined to be clarified. Either he will live, or he will die;

אבל ההיא דחבית ובהמה שמא לא יחלקו לעולם

Regarding the barrel and animal, perhaps they will never divide.

וכן אנו צריכין לומר דלא תיקשי דר' יוסי דהכא אדרבי יוסי בפרק מי שאחזו (שם דף עג.) דקאמר מה היא באותן הימים ר' יוסי אומר מגורשת ואינה מגורשת

Support: We must say so to avoid a contradiction between R. Yosi here and in Gitin (73a), where he says that [if a man gave a Get 'from today if I die'], in the interim, she has the stringencies of being divorced and not divorced.

ולכי מיית הוי גיטא אלמא יש ברירה

When he dies, the Get is valid. This shows that Yesh Breirah!

Disclaimer: Even without this [distinction between a matter destined to be clarified, and one that is not], this is not difficult;

דמצי לחלק בין היכא דתולה בדעת עצמו לית ליה ברירה

We could distinguish between one who is Toleh (makes a stipulation contingent on his own will - in such a case he holds that Ein Breirah...

אבל היכא דתולה בדעת אחרים בהקדוש ברוך הוא שחייו ומותו תלוי בידו יש ברירה

i.

However, if one is Toleh on others' will, [i.e.] Hash-m, on whom his life depends, in such a case he holds that Yesh Breirah.

ולמאן דלא מפליג בין דעת עצמו לתולה בדעת אחרים לישני דטעמא דר' יוסי הכא משום בקיעת הנוד

2.

According to the opinion that does not distinguish between Toleh on one's own will and others' will, we [could] answer that the reason for R. Yosi here is lest the barrel break (even though he holds that Yesh Breirah).

אבל קשה למאן דלא מפליג דשמעינן לרבי יוסי דלית ליה ברירה אף על פי שמתנה ומברר דבריו

(q)

Question: However, according to the opinion that does not distinguish [between his will and others'], we find that R. Yosi holds that Ein Breirah even when he stipulates and clarifies his words!

בפ' בכל מערבין (עירובין דף לז:) האומר מעשר שני שיש לי בבית יהא מחולל על סלע שתעלה בידי מן הכיס רבי יוסי אומר לא חילל

Citation (Eruvin 37b - R. Yosi): If one says "Ma'aser Sheni in my house will be redeemed on the coin I will take out of my wallet", it is not redeemed.

ולפי תירוץ שני שתרצנו אליבא דשמואל ניחא דבפרק מי שאחזו עומד להתברר או יחיה או ימות

Answer: This is good according to Resolution #2 for Shmuel, above. In Gitin, it will be clarified - he will live or die;

אבל התם שמא לא תעלה סלע בידו מן הכיס דשמא יגנב או יניח אותו כך לעולם

However, there, perhaps he will never pull out a coin. Perhaps the wallet will be stolen, or he will leave it [and never take one out]!

ומה שהוצרכנו לחלק אליבא דשמואל דבפרק מי שאחזו (גיטין דף עה:) אית ליה ברירה היינו לפרש"י דפי' דבכי האי גוונא נמי שייך ברירה ולא דמי לשאר תנאי דעלמא

Explanation: We needed to distinguish according to Shmuel, for in Gitin (75b) he holds that Yesh Breirah. This is according to Rashi, who says that Breirah applies in such a case. It is unlike other Tenayim;

אבל אי אמרינן דכל דבר שהוא כעין תנאי לא שייך ביה ברירה כי ההיא דשמואל דמי שאחזו (שם) לא קשה מידי

However, if we would say that Breirah does not apply to anything like a Tenai, like Shmuel's case in Gitin, there is no difficulty at all.

והא דדייק בפרק כל הגט (שם דף כה:) מההיא דמה היא באותן הימים וכו' ולכי מיית הוי גיטא אלמא יש ברירה
