SHECHITAH OF PAR YOM KIPUR (Yerushalmi Perek 3 Halachah 7 Daf 18a)

[דף יח עמוד א] [דף כג עמוד א (עוז והדר)] מתני' בא לו אצל פרו ופרו היה עומד בין האולם ולמזבח ראשו לדרום ופניו למערב הכהן עומד במזרח ופניו למערב

(a)

(Mishnah): He came to his ox. His ox was standing between the Ulam and the Mizbe'ach - its head was to the south and its face to the west. The Kohen stands east [of the ox], and his face to the west.

סמך שתי ידיו עליו ונתודה וכך היה אומר אנא השם עויתי פשעתי חטאתי לפניך אני וביתי אנא השם כפר נא לעונות לפשעים ולחטאים שעויתי ושפשעתי ושחטאתי לפניך אני וביתי ככתוב בתורת משה עבדך [ויקרא טז ל] כי ביום הזה יכפר עליכם וגו'

(b)

He pressed both his hands on it and confessed. He said 'please, Hash-m - I sinned [intentionally, rebelliously and b'Shogeg] in front of You - I and my household. Please, Hash-m - atone for the [intentional, rebellious and Shogeg] sins that I sinned in front of You, I and my household, like it says in the Torah of Moshe Your servant "Ki ba'Yom ha'Zeh Yechaper Aleichem...'''

והן עונין אחריו ברוך שם כבוד מלכותו לעולם ועד:

They answer after him "Baruch Shem Kevod Malchuso l'Olam va'Ed.''

גמ' אי זהו צפונו של מזבח שהוא כשר בשחיטת קדשי קדשים מקירו של מזבח צפוני ועד כותל העזרה צפוני עד כנגד כל המזבח ישנן כשלשים ושתים אמה דברי רבי [צ''ל מאיר - פני משה]

(Gemara) Question: What is north of the Mizbe'ach, which is Kosher for Shechitas Kodshei Kodoshim? It is from the north wall of the Mizbe'ach until the north wall of the Azarah, opposite the entire Mizbe'ach, a width of 32 Amos. R. Meir says so;

R. Elazar b'Ribi Shimon adds opposite between the Ulam and the Mizbe'ach, until opposite Beis ha'Chalifos (where the Ulam sticks out from the Heichal);

רבי מוסיף מקום דריסת רגלי ישראל אחת עשרה אמה מקום דריסת רגלי הכהנים אחת עשרה אמה מקירו של מזבח הצפוני ועד כותל העזרה (המזרחי) [צ''ל הצפוני - קרבן העדה]

Rebbi adds the place where Yisraelim [normally] walk, and the place where Kohanim walk, 11 Amos, from the north wall of the Mizbe'ach until the north wall of the Azarah.

Rav commanded his Talmidim "everywhere, teach Zerikah (if a Zar did it, it is Pasul), except for Parah [Adumah. There,] teach [even] for Shechitah.''

וא''ר יוחנן לא מצאנו שחיטה פסולה בזר

(f)

(R. Yochanan): We do not find Shechitah Pasul through a Zar.

התיב ר' חייה בר בא והא כתיב [במדבר יט ג ד] ושחט והזה מה הזייה לא הוכשרה באשה כאיש [דף כג עמוד ב (עוז והדר)] אף שחיטה לא הוכשרה באשה כאיש

Question (R. Chiyah bar Ba): It is written [about Parah Adumah] "v'Shachat v'Hizah'' - just like Haza'ah is not Kosher through a woman like through a man, also Shechitah is not Kosher through a woman like through a man. (A Zar is no better than a woman.)

א''ל הרי הזייה מיימיה הרי היא כשירה בזר ופסולה באשה

Answer (R. Yochanan): Haza'ah of its water is Kosher through a Zar and Pasul through a woman!

א''ל תמן לית כתב כהן וליידא מילתא כתב איש להכשיר את הזר היא איש היא אשה

(i)

Question (R. Chiyah bar Ba): There (Haza'ah) it is not written Kohen. Why does it say Ish - to be Machshir a Zar?! (There is no reason to disqualify! Rather, it is to disqualify a woman, for we would have thought that) a man and woman are the same;

ברם הכא כתיב כהן היא זר היא אשה אין תימר שהיא כשירה בזר תיכשר באשה

However, here [Shechitah] it is written Kohen. A Zar and woman are the same. If you will say that she is Kosher, a Zar is Kosher. (Kohen teaches that a Kohen must oversee the Shechitah.)

(R. Yishmael bar Rav Yitzchak citing R. Yochanan citing R. Shimon ben Yochai): The ox of Yom Kipur needs a Kohen [to slaughter it].

ולמה לא אמר ושעיר

Question: Why didn't he say that the goat [needs a Kohen]?

דו קרייא ושחט והביא מה הבאה בכהן אף שחיטה בכהן

Answer: A verse [clearly teaches about the goat] - "v'Shachat... v'Hevi'' - just like Hava'ah [bringing its blood] is through a Kohen, also Shechitah is through a Kohen.

(m)

(R. Yakov bar Acha citing R. Yosa citing R. Yochanan citing R. Shimon ben Yochai): The ox and goat of Yom Kipur need a Kohen.

SAYING SHEM HA'MEFURASH

א''ר חגייא בראשונה הוא אומר אנא השם ובשנייה הוא אומר [דף יח עמוד ב] אנא בשם

(a)

(R. Chagiya): [In his Viduy,] the first time, he says "Ana Hash-m.'' The second time, he says "Ana ba'Shem.''

תני כיצד מתוודה עויתי פשעתי חטאתי ואומר [שמות לד ז] נושא עון ופשע וחטאה ואומר [ויקרא טז כא] והתודה עליו את כל עונות בני ישראל דברי ר''מ

(b)

(Beraisa): How does he confess? "Avisi Pashati Chatasi'', and it says "Nosei Avon va'Fesha v'Chata'ah'', and it says "v'Hisvadah Alav Es Kol Avonos Bnei Yisrael [v'Es Kol Pish'eihem l'Chol Chatosam].'' R. Meir says so;

וחכ''א עונות אילו הזדונות פשעיהם אילו המרדים חטאתם אילו השגגות

(c)

Chachamim say, Avonos are intentional sins. Pesha'im are sins of rebellion. Chata'im are Shogeg.

מאחר שהוא מתודה על הזדונות ועל המרדים הוא חוזר ומתודה על השגגות

(d)

Question: After he confesses for Mezid and rebellion, does he confess for Shogeg?!

אלא כך היה מתודה אנא השם חטאתי עויתי פשעתי לפניך אני וביתי ובני אהרן ככתוב בתורת משה עבדך לאמר [שם ל] כי ביום הזה וגו' והן עונין אחריו ברוך שם כבוד מלכותו לעולם ועד

(e)

Answer: So he confesses. Ana Hash-m Chatasi Avisi Pashati in front of You, I and my household and Bnei Aharon, like it says in the Torah of Moshe Your servant "Ki Ba'Yom ha'Zeh...'' and they answer Baruch Shem Kevod Malchuso l'Olam va'Ed.

וכן מצינו דרך כל המתודים דוד אמר [תהילים קו ו] חטאנו עם אבותינו העוינו והרשענו שלמה בנו אמר [מלכים א ח מז] חטאנו (העוינו) [צ''ל והעוינו] רשענו דניאל אמר [דניאל ט ה] חטאנו עוינו הרשענו ומרדנו

And so we find all who confess. David said "Chatanu Im Avoseinu He'evinu v'Hirshanu.'' His son Shlomo said "Chatanu v'He'evinu Rashanu.'' Daniel said "Chatanu Avinu Hirshanu v'Maradnu'';

אף הוא כך היה מתודה חטאתי עויתי פשעתי לפניך

Also [the Kohen Gadol] confessed Chatasi Avisi Pashati in front of You.

מהו שמשה אמר נושא עון ופשע וחטאה ואומר והתודה עליו את כל עונות בני ישראל וגו' אלא מכיון שהוא מתודה על הזדונות ועל המרדים כאילו הן שגגות לפניו.

Why did Moshe (i.e. the Torah) say "Nosei Avon va'Fesha v'Chata'ah'', and "v'Hisvadah Alav Es Kol Avonos Bnei Yisrael [v'Es Kol Pish'eihem l'Chol Chatosam]''? Rather, since he confesses for Mezid and rebellion, it is as if they are Shegagos in front of Him.

עשרה פעמים היה כהן גדול מזכיר את השם ביום הכפורים ששה בפר וג' בשעיר ואחד בגורלות

The Kohen Gadol mentioned [Shem ha'Mefurash] 10 times on Yom Kipur - six over the ox (three in his Viduy for his household , and three in his Viduy for the Kohanim), three [in the Viduy for Yisrael] over the goat, and one in the lottery. (SHIREI KORBAN - Rav Hai Gaon says that this was the 42-letter name. The Rosh disagrees.)

הקרובים היו נופלין על פניהן הרחוקים היו אומרים בשכמל''ו אלו ואלו לא היו זזים משם עד שהוא מתעלם מהן [שמות ג טו] זה שמי לעולם זה שמי לעלם.

Those nearby fell on their faces [when they heard Shem ha'Mefurash]. Those far away said Baruch Shem Kevod Malchuso l'Olam va'Ed. Both of them forgot it [immediately,] before they budged from there, for it says "Zeh Shmi l'Olam'' - Zeh Shmi Le'alem (His name is hidden).

בראשונה היה אומרו בקול גבוה משרבו הפרוצין היה אומרו בקול נמוך

At first, he used to say [Shem ha'Mefurash] loudly. After sinners increased (they would use His name even though they did not know it properly, or write it down), he said it softly.

[דף כד עמוד א (עוז והדר)] א''ר טרפון עומד הייתי בין אחי הכהנים בשורה והטיתי אזני כלפי כהן גדול ושמעתיו מבליעו בנעימת הכהנים.

(g)

(R. Tarfon): I was standing amidst my brethren Kohanim in a line, and I bent my ear towards the Kohen Gadol, and I heard him swallow [say Hash-m's name in Birkas Kohanim so it would not be heard] amidst the Kohanim's singing.

בראשונה הוא נמסר לכל אדם משרבו הפרוצים לא היה נמסר אלא לכשירים.

At first, [Shem ha'Mefurash] was handed over to anyone. After sinners increased, it was handed over only to [those known to be] Kesherim.

שמואל הוה עבר שמע פרסייא מקלל לבריה ביה ומית אמר אזל גוברא ומאן דשמע שמע

(h)

Shmuel was passing. He heard a Persian curse his son with Shem ha'Mefurash, and he died. [Shmuel] said [he did two evils] - a person died, and one who heard, he heard (HA'GAON RAV C. KANIEVSKY, SHLITA).

ר' איניוני בר סוסיי סלק גבי ר' חנינה לציפורין אמר איתא ואנא מסר יתיה לך עאל ליה בריה תחותי ערסא עטש ושמע קליה אמר מה אתון נהיגין גביכון ברמיו אזל לא לך ולא ליה

(i)

R. Inyoni bar Susai went out to R. Chaninah to Tziporin. He said "come, and I will hand over [His name] to you.'' [R. Chaninah's] son entered under the bed [to overhear the name]. He sneezed. [R. Inyoni] said "do you conduct with trickery?! Not to you and not to him [will I reveal]!

חד אסי בציפורין אמר לרבי פינחס בר חמא איתא ואנא מסר ליה לך א''ל לית אנא יכיל אמר למה א''ל דאנא אכיל מעשר ומאן דרגיל ליה לא יכיל מיכול מבר נש כלום:

There was a doctor in Tziporin. He said to R. Pinchas ben Chama "come, and I will hand over [His name] to you.'' He said "I cannot.'' He asked why. He said "I eat Ma'aser (I am a Levi), and one who is familiar [with His name] may not eat anything from other [people].
