VIDUY ON SE'IR HA'MISHTALE'ACH (Yerushalmi Perek 6 Halachah 2 Daf 33a)

מתני' בא לו אצל שעיר המשתלח וסמך שתי ידיו עליו ונתוודה וכך היה אומר אנא השם עוו פשעו חטאו לפניך עמך בית ישראל אנא השם כפר נא וגומר:

(a)

(Mishnah): He came to Se'ir ha'Mishtale'ach, pressed both his hands on it and confessed. He said as follows - Ana Hash-m - Avu Pash'u Chat'u in front of You, Your nation Beis Yisrael. Ana Hash-m, please atone...

גמ' תני בר קפרא עוו פשעו חטאו שלא להזכיר גניין של ישראל

(Beraisa - Bar Kapara): [He does not mention Yisrael. He says only] Avu Pash'u Chat'u, not to mention the disgrace of Yisrael.

יעמד חי מלמד שהוא עתיד למות עד מתי הוא חיה עד וכלה מכפר את הקודש דברי ר' יהודה

"Ya'amad Chai'' teaches that it is destined to die. Until when must it live? Until "v'Chilah mi'Kaper Es ha'Kodesh.'' R. Yehudah says so;

R. Shimon says, [it must live] until the time of Viduy.

R. Yehudah holds that the Viduy is Me'akev. R. Shimon holds that the Viduy is not Me'akev.

מה נפק מן ביניהון שלחו בלא וידוי ע''ד דר' יהודה צריך להביא שעיר אחר על דעתיה דר''ש אינו צריך להביא שעיר אחר

What do they argue about? If he sent it without Viduy, R. Yehudah holds that he must bring another goat. R. Shimon holds that he need not bring another goat.

אף בפר כן שחטו בלא וידוי על דעתיה דרבי יהודה צריך להביא פר אחר על דעתיה דר''ש אינו צריך להביא פר אחר

(g)

The same applies to the bull. If he slaughtered it without Viduy, R. Yehudah holds that he must bring another bull. R. Shimon holds that he need not bring another bull.

נתוודה ושחטו ונשפך הדם ואת אמר צריך להביא פר אחר צריך להתוודות עליו פעם שנייה או כבר יצא בוידוייו של ראשון

Question: If he confessed, slaughtered it and the blood spilled, and you say (i.e. all agree) that he must bring another bull, must he confess on it again, or was he already Yotzei through the Viduy on the first? (We can ask even according to R. Shimon. He agrees that l'Chatchilah, one must do Viduy.)

אף בשעיר המשתלח כן צריך להגריל עליו פעם שנייה או כבר יצא בהגרילו של ראשון:

Question: Also regarding the Se'ir ha'Mishtale'ach [according to the opinion that the lottery is Me'akev], must he do a lottery on it a second time, or was he already Yotzei through the lottery on the first?

SENDING THE GOAT TO AZAZEL (Yerushalmi Perek 6 Halachah 3 Daf 33a)

מתני' מסרו למי שהוא מוליכו הכל כשירין להוליכו אלא שעשו כהנים גדולים קבע ולא היו מניחין ישראל להוליכו

(a)

(Mishnah): They handed over [Se'ir ha'Mishtale'ach] to the one who will take it. Anyone is Kosher to take it, but Kohanim Gedolim made it fixed, and did not allow a Yisrael (Zar) to take it.

אמר רבי יוסי מעשה והוליכו ערשלא מציפורין וישראל היה:

R. Yosi says, a case occurred and Arshela of Tziporim took it, and he was a Yisrael.

[דף מג עמוד א (עוז והדר)] גמ' [ויקרא טז כא] ושלח ביד איש להכשיר את הזר עתי שיהא עתיד עתי שיהא מזומן עתי אף בשבת עתי אף בטומאה

(Gemara): "V'Shilach b'Yad Ish'' is Machshir a Zar. "Iti'' - he is prepared for this. "Iti'' - he is designated for this. "Iti'' - even on Shabbos. "Iti'' - even b'Tum'ah.

Question: Is not "prepared'' the same as "designated''?!

אלא שלא ישלחנו ביד שנים

Answer: Rather, [change one of them to say that] he may not send it with two people.

שילחו ביד שנים מהו שיטמא בגדים

Question: If he sent it with two (e.g. one took it half-way, and handed it over to someone else to finish taking it), is it Metamei clothes [of both of them]?

נישמעינה מן הדא והמשלח לא המשלח את (המשתלח) [צ''ל המשלח - פני משה] הדא אמרה שילחו ביד שנים אינו מטמא [דף לג עמוד ב] בגדים

Answer: [Toras Kohanim expounds] "Veha'Meshale'ach [Es ha'Sa'ir la'Azazel]'', and not one who sends the Meshale'ach. This teaches that if he sent it with two, [the first] is not Metamei Begadim.

ברח דרך הליכה מטמא בגדים דרך חזירה אינו מטמא בגדים

(h)

If it fled in the direction [towards the Tzuk (steep mountain from which he pushes it), the Meshale'ach] is Metamei Begadim [while pursuing it]. If it fled in the other direction, he is not Metamei Begadim. (Starting from the question, we explained like PNEI MOSHE.)

שאלו את ר''א חלה השליח אמר להן כך תהו בשלום

(i)

Question #1: They asked R. Eliezer, if the Shali'ach became sick (may he give it to another Shali'ach)? He answered, just like he will be well (Sheluchei Mitzvah are not harmed - MASA D'YERUSHALAYIM), you should be well! (This was not a proper answer, for "Sheluchei Mitzvah are not harmed'' does not apply when danger is common, e.g. they designated a very weak Shali'ach - PF.)

ואם חלה המשתלח אמר להן יכול הוא לטעון אתכם ולי

(j)

Question #2: If the [Se'ir] ha'Mishtale'ach became sick [what is the law]? He said, [they pick strong goats for the lottery]. It can carry you and me (it will not get sick).

דחייו ולא מת אמר להן כך יהו אויבי השמים

(k)

Question #3: If he pushed it [off the Tzuk] and it did not die [must he go to kill it]? He said, so should be Shamayim's enemies (surely it will die).

לא שהיה ר''א מפליגן אלא שלא היה אומר להן דברים שלא שמעון מימיו

R. Eliezer did not divert them [because he did not know the answers]. Rather, he would not say to them (or anyone) matters that he never heard [from his Rebbeyim].

וחכמים אומרים חלה השליח משלחו ביד אחר חלה המשתלח מרכיבו על החמור דחייו ולא מת יורד אחריו וממיתו.

(m)

Answers (Chachamim): If the Shali'ach became sick, he sends it with someone else. If the Mishtale'ach became sick, [he puts it on a donkey and] the donkey carries it]. If he pushed it and it did not die, he descends after it and kills it.

THE DECLINE AFTER THE DEATH OF SHIMON HA'TZADIK

כל ימים שהיה שמעון הצדיק קיים לא היה מגיע למחצית ההר עד שנעשה איברין איברין משמת שמעון הצדיק היה בורח למדבר והסרקין אוכלין אותו

(a)

As long as Shimon ha'Tzadik was alive, it did not reach (fall) half the mountain before it was [torn into] many pieces. After Shimon ha'Tzadik died, it would flee to the Midbar, and Yishmaelim would eat it (PNEI MOSHE, ARUCH).

כל ימים שהיה שמעון הצדיק קיים היה גורל של שם עולה בימין משמת שמעון הצדיק פעמים בימין פעמים בשמאל

(b)

As long as Shimon ha'Tzadik was alive, the lot for Hash-m came up in his right hand. After Shimon ha'Tzadik died, sometimes it came up in his right hand, and sometimes in his left.

כל ימים שהיה שמעון הצדיק קיים היה נר מערבי דולק משמת שמעון הצדיק פעמים כבה פעמים דלק

(c)

As long as Shimon ha'Tzadik was alive, the Ner Ma'aravi burned [also the entire day]. After Shimon ha'Tzadik died, sometimes it extinguished [in the morning], and sometimes it burned.

כל ימים שהיה שמעון הצדיק קיים היה לשון של זהורית מלבין משמת שמעון הצדיק פעמים מלבין פעמים מאדים

(d)

As long as Shimon ha'Tzadik was alive, the red strip [tied to Se'ir ha'Mishtale'ach] would whiten. After Shimon ha'Tzadik died, sometimes it whitened, and sometimes it became even redder.

כל ימים שהיה שמעון הצדיק קיים היה אור המערכה מתגבר ועולה משהיו נותנין שני גזירי עצים בשחרית לא היו נותנין כל היום משמת שמעון הצדיק תשש כוחה של מערכה ולא היו נמנעין להיות נותנין עצים כל היום.

(e)

As long as Shimon ha'Tzadik was alive, the fire of the Ma'arachah became stronger. From when they put two logs in the morning, they did not put [more wood] the entire day. After Shimon ha'Tzadik died, they did not refrain from putting wood the entire day.

כל ימים שהיה שמעון הצדיק קיים היתה ברכה משולחת בשתי הלחם ובלחם הפנים והיה נופל לכל אחד ואחד עד כזית ויש מהן שהיו אוכלים ושביעין ויש מהן שהיו אוכלין ומותירין.

As long as Shimon ha'Tzadik was alive, there was a Brachah in Shtei ha'Lechem and Lechem ha'Panim. Everyone would get a k'Zayis. Some ate and were satiated, and some ate and [were satiated from part of it] and left over;

משמת שמעון הצדיק ניטלה ברכה משתי הלחם ומלחם הפנים והיה נופל לכל אחד ואחד מהן עד כאפון הצנועים היה מושכין את ידיהן והגרגרנים היו פושטין את ידיהן.

After Shimon ha'Tzadik died, the Brachah was removed from Shtei ha'Lechem and Lechem ha'Panim. Everyone would get the size of a pea. Pious [Kohanim] refrained [from taking], and gluttons stretched their hands [and took];

מעשה בכהן אחד בציפורין שנטל חלקו וחלק חבירו והוא היה נקרא בן (האפון) [צ''ל חמצן - קרבן העדה] עד היום [דף מג עמוד ב (עוז והדר)] הוא

A case occurred in which a Kohen [from] Tziporin took his portion and his friend's portion, and they called him "Ben Chamtzan'' to this day;

שדוד אמר [תהילים עא ד] אלהי פלטיני מיד רשע מכף מעוול וחומץ.

David said "Elokai Palteini mi'Yad Rasha mi'Kaf Me'avel v'Chometz.''

תני ארבעים שנה עד שלא חרב בית המקדש היה נר מערבי כבה ולשון של זהורית מאדים וגורל של שם עולה בשמאל והיו נועלין דלתות ההיכל מבערב ומשכימין ומוצאין אותן פתוחין

(Beraisa): Forty years before the Churban, the Ner Ma'aravi used to extinguish, and the red strip used to redden [even more], and the lot for Hash-m came up in his left hand, and they would lock the doors of the Heichal at night and in the morning, they found them open;

אמר לו רבן יוחנן בן זכיי היכל למה אתה מבהלינו יודעין אנו שסופך ליחרב שנאמר [זכריה יא א] פתח לבנון דלתיך ותאכל אש בארזיך.

R. Yochanan ben Zakai said to [the Heichal] 'Heichal, why do you startle us? We know that in the end you will be destroyed - "Pesach Levanon Delasecha v'Sochal Esh ba'Arazecha''.'

ארבעים שנה שימש שמעון הצדיק את ישראל בכהונה גדולה ובשנה האחרונה אמר להן בשנה זו אני מת אמרו לו למי נמנה אחריך

Shimon ha'Tzadik served 40 years as Kohen Gadol for Yisrael. In the last year, he said to them "this year, I will die.'' They said, who will we appoint after you?

אמר להן הרי נחוניון בני לפניכם הלכו ומינו את נחוניון וקינא בו שמעון אחיו והלך והלבישו אונקלה וחגרו צלצל.

He said, Nechunyon my son is in front of you. Go appoint Nechunyon. His brother Shimon was envious, and went and dressed him in a leather garment and girded him with [a woman's] belt.

אמר להן ראו מה נדר לאהובתו א''ל לכשאשמש בכהונה גדולה אלבש נקלה שליך ואחגור בצלצל שליך. בדקו את הדברים ולא מצאו אותו

Shimon said [to the other Kohanim] "see what [Nechunyon] vowed to his beloved! He told her, when I will serve as Kohen Gadol, I will wear your garment and gird with your belt! They investigated the matter, and did not find him.

אמרו משם ברח להר המלך. משם ברח לאלכסנדריאה ועמד ובנה שם מזבח וקרא עליו את הפסוק הזה [ישעי' יט יט] ביום ההוא יהיה מזבח לה' בתוך ארץ מצרים

They said that from there he fled to Har ha'Melech. from there he fled to Alexandria, and built a Mizbe'ach and applied to it this verse "ba'Yom ha'Hu Yihyeh Mizbe'ach la'Shem b'Soch Eretz Mitzrayim.''

והרי הדברים ק''ו ומה אם זה (שברח מן השררה ראו היאך נחזר עליה בסוף מי שהוא נכנס ויוצא) [צ''ל שלא נכנס לשררה וכו' מי שכבר נכנס לשררה ויצא על ידי שהורידוהו - פני משה] על אחת כמה וכמה תני זו דברי ר''מ

There is a Kal v'Chomer. If this one (Shimon) who never entered authority (craved authority so much that he did such evil trickery)... one who already entered authority and left, for he was demoted, all the more so! R. Meir said so;

ר' יהודה אומר לא כי אלא מינו את שמעון וקינו בו נחונין אחיו והלך והלבישו נקלה וחגרו צלצל א''ל ראו מה נדר לאהובתו כו' היך קדמייא

R. Yehudah says, it was not like this. Rather, they appointed Shimon (because Nechunyon declined to accept - MEICHAL HA'MAYIM), and Nechunyon his brother was jealous. He dressed [Shimon] in a leather garment and girded him with a belt. [Nechunyon] said [to the Kohanim] "see what he vowed to his beloved...!'', like in the first version (R. Meir. They investigated and found what he plotted, and Nechunyon fled to Alexandria);

והרי הדברים קל וחומר ומה אם (מי שלא נכנס לשררה ראו האיך העשיא את ישראל לעכו''ם מי שהוא נכנס ויוצא) [צ''ל זה שברח מן השררה ראו היאך נחזר עליה בסוף מי שהוא נכנס ויוצא - פני משה] על אחת כמה וכמה:

There is a Kal v'Chomer. If this one (Nechunyon) who fled authority, see how much he pursued it at the end, one who entered authority and leaves, all the more so! (We explained this episode according to PNEI MOSHE.)
