ONE WHO SOLD OLIVE TREES (Yerushalmi Halachah 5 Daf 31a)
משנה המוכר זיתיו לעצים ועשו פחות מרביעית לסאה הרי הן לבעל הזיתים
(Mishnah) If one sold his olive trees for wood and (he waited before chopping them down and) they (poorly) produced (olives that could be squeezed for) less than a revi'is of oil per se'ah, they belong to the buyer of the trees.
עשו רביעית לסאה זה אומר זיתיו גידילו וזה אומר ארצי גידלה יחלוקו
However, if they could produce a revi'is of oil (or more) per se'ah - the buyer claims that the oil is his, because it was his trees that produced the olives. The seller claims that the oil is his, because it was his land that grew them. The law is that they divide the oil.
שטף הנהר את זיתיו ונתנן לתוך שדה חבירו זה אומר זיתיי גידילו וזה אומר ארצי גידילה יחלוקו:
If an overflowing river washed his olive trees into another field (and they grew olives there and produced oil), the buyer claims that it is his because it was his olives that produced the oil. The seller claims that it is his, because his land grew the olives. The law is that they divide the oil.
גמרא ר' יוחנן בעי הרטיבו מה הן.
Question (R. Yochanan): If they became moist from the second field, why does the second field owner have a full claim on the olives rather than having to divide it with the tree owner?
רב הונא אמר בששטפן בגושיהן
Rav Huna: They were washed away with their (moist) soil (so the tree owner's property also caused the growth).
ר' יוסי בן חנינא אומר שני ערלה ביניהן:
R. Yosi ben Chanina: A difference between the views of these two (R. Yochanan and Rav Huna) would be whether these trees are considered newly planted for waiting the years of Orlah. (R. Yochanan would require him to wait and Rav Huna would not, since its accompanying soil makes it as if it is not newly planted.)
INFORMING A RENTER THAT HE MUST LEAVE (Yerushalmi Halachah 6 Daf 31a)
משנה המשכיר בית לחבירו בימות הגשמים אינו יכול להוציאו מן החג עד הפסח
(Mishnah): One who rents out a house to his friend in the rainy season (for an unspecified time) may not force him to leave between Sucos (lit. the festival) and Pesach.
ובימות החמה שלשים יום
(If he wishes to make him leave) in the sunny season, he must inform him 30 days beforehand.
ובכרכין אחד ימות החמה ואחד ימות הגשמים שנים עשר חדש
In large cities (where rental properties are less available), whether in the sunny or rainy seasons, he must inform him 12 months beforehand.
ובחנויות אחד כרכין ואחד עיירות שנים עשר חדש
Shopkeepers, whether in big cities or in towns, must inform (customers of their intent to collect payment of credit) 12 months before (they collect the debts).
[דף ל עמוד א (עוז והדר)] רשב''ג אומר חנות של נחתומין ושל צבעין שלש שנים:
Rabban Shimon ben Gamliel: A bakery and a dyer must inform them 3 years beforehand.
גמרא תני כל אילו שאמרו שלשים יום וי''ב חדש לא שידור בתוכן שלשים יום וי''ב חדש אלא שיודיעו קודם שלשים יום וקודם י''ב חדש.
(Gemara) - Beraisa: In all cases when Chazal said 30 days or 12 months, they were not referring to the duration of the rental but rather, to the length of time before they force the renters to leave that they must inform them of their plans, whether it is 30 days or 12 months.
בית הבד כל שעת בית הבד בית הגת כל שעת הגת.
(The amount of time that the owner must inform the renter before he plans to make the renter leave depends on the type of property...) - for an olive press, the entire time of pressing; for a wine press, the entire time of pressing.
בית היוצרה אין פחות משנים עשר חודש.
For a factory, no less than 12 months.
א''ר יוסי במה דברים אמורים באילין שהן עושין בעפר שחור אבל באילו שעושין בעפר לבן כונס גורנו ומסתלק:
R. Yosi: When is this the case? For those using dark earth (because their work is more extended), but for those using light earth, the renter can just gather in his utensils and leave (so he does not need such advanced warning).
RESPONSIBILITIES OF A LANDLORD AND A RENTER (Yerushalmi Halachah 7 Daf 31b)
[דף לא עמוד ב] משנה המשכיר בית לחבירו המשכיר חייב בדלת ובנגר ובמנעול ובכל דבר שהוא מעשה אומן
(Mishnah): If one rents out a house to his friend, the owner is responsible for the door, the bolt and the lock and for anything that requires a craftsman's expertise.
אבל דבר שאינו מעשה אומן השוכר עושהו
But something that does not involve expertise is the renter's responsibility.
הזבל של בעל הבית אין לשוכר אלא היוצא מן התנור ומן הכיריים בלבד:
Manure (that gathered in the courtyard from the animals of others) belongs to the landlord; the renter only has rights to the ashes that come from the oven and stove.
