Answer: In any case (also regarding the bull and goat of Yom Kipur that were lost, and others were offered in their place, when the first animals are found), they cannot be offered. What is the difference [whether they cannot be offered due to] this Pesul (the owners died) or this Pesul (others were offered in place of them)?
ואפילו הכי שמעינן ליה דירעו.
Even so, we find that [R. Shimon] says that they graze.

Question: How can he be Shogeg (about the action) without (being Shogeg also about the) Hora'ah?
אי אכיל בשתיקה ולא מיקרי הוראה
Suggestion: He ate silently (he did not say whether or not it is permitted), and this is not called Hora'ah.
הא מאחר שאינו מורה לאחרים כי אם לעצמו מה לי בשתיקה מה לי בדיבור.
Rejection: Since he does not rule for others, rather, only for himself, what is the difference whether he was silent, or spoke?!
TOSFOS DH k'Hora'as Beis Din v'Chulei

וצריך לומר דתנא התם (הגהת בארות המים) אגב דתנא הכא
Answer: We must say that there it was taught Agav (due to) what was taught here;
דהתם ליכא לשנויי כדהכא דהיכי סלקא דעתך למימר דכולהו סנהדרין שכחו מאיזה טעם הורו.
There, we cannot answer like here. How could one think to say that the entire Sanhedrin forgot due to which reason they ruled?!
