THE CONNECTION OF SHAVING AND BI'AS MIKDASH (Yerushalmi Perek 7 Halachah 4 Daf 37b)

(Mishnah - R. Elazar, citing R. Yehoshua): Every Tum'as Mes for which a Nazir shaves, one is liable for it for Bi'as (entering the) Mikdash [with that Tum'ah]. Every Tum'as Mes for which a Nazir does not shave, he is exempt for Bi'as Mikdash;
àîø ø' îàéø ìà úäà æå ÷ìä îï äùøõ
R. Meir says, [the latter Tum'os] are no more lenient than [one who touched] a Sheretz, [who is liable for Bi'as Mikdash]!

R. Akiva: I reasoned in front of R. Eliezer - a bone k'Se'orah is not Metamei a person b'Ohel, yet a Nazir shaves for touching or moving it. A Revi'is of blood is Metamei a person b'Ohel, all the more so a Nazir should shave for touching or moving it!

He told me, Akiva, you cannot make a Kal v'Chomer here [from a tradition from Sinai].

R. Akiva: When I related [the conversation] in front of R. Yehoshua, he said 'you said well (GRA - normally, we can make a Kal v'Chomer from a tradition), but so the Halachah was said [we have a tradition unlike your Kal v'Chomer].

(Gemara - Mishnah): Two people can become Tamei due to a Mes - one has Tum'as Shiv'ah (he requires Haza'as Mei Chatas on days three and seven), and one has Tum'as Erev (he immerses, and he is totally Tahor at night).

Three can become Tamei due to a Mes - two get Tum'as Shiv'ah, and one gets Tum'as Erev.

What is the case [of two]? One touched a Mes - he has Tum'as Shiv'ah. One who touches him, he has Tum'as Erev...

(R. Yochanan citing R. Yanai): All of them [mentioned in this Mishnah, who become Tamei] it is mid'Oraisa for [lashes for eating] Terumah, but for Bi'as Mikdash, only the second, who touched the first [who touched the Mes] is liable.

What is the reason? "V'Ish Asher Yitma v'Lo Yischata" - one who needs Chituy (Haza'as Mei Chatas, one who touches him) is liable for Bi'as Mikdash. One who does not need Chituy, (one who touches him) is not liable for Bi'as Mikdash.

Question: One who touches Kelim, and they touched a Mes, he needs Chituy, and he is a Sheni! (According to this reason, one who touches him should be liable, but R. Yochanan exempts one who touches a Sheni!)

Answer (R. Avin bar Chiyah): [The verse obligates] for Tum'as Ish b'Ish (a man touched a man), but not for Tum'as Ish b'Kelim.

Explanation: According to R. Avin bar Chiyah, he is liable only for [touching] the first (the Mes). Since when a man [becomes Tamei] from a man, only [one who touches] the first is liable (since the second has only Tum'as Erev), also here (when a man becomes Tamei from Kelim), only [one who touches] the first is liable (even though also one who touches the Sheni gets Tum'as Shiv'ah).
àîø øáé éåñé åäåà ùèáì àáì àí ìà èáì äãà äéà ãøáé
(R. Yosi): [One who touched a Sheni with Tum'as Shiv'ah, i.e. through Kelim, if he received Haza'ah on days three and seven, he is exempt] only if he immersed (even though he is not fully Tahor until night), but if he did not immerse, this is like Rebbi taught;
ãøáé àîø ëì äèîàéí áèåîàúï òã ùéáåàå áîéí
(Rebbi): All Temei'im remain in their Tum'ah until they enter water (immerse. However, one who touched a Rishon is liable until he is fully Tahor at night.).
àîø ø' àéìà äåà òöîå ùðâò áîú çééá
(R. Ila): If he himself touched a Mes, he is liable [for Bi'as Mikdash, but one who touches him is not].
àîøä åàîø èòîà àùø éèîà áèåîàú àéù äåà
He said [this], and he said the reason - "[Ish] Asher Yitma" - one who is proper to be Metamei a man. (One who touches one who touched a Mes, he cannot be Metamei a man.)

Question: [One who touched Kelim that touched a Mes,] he is Shelishi (counting the Mes as the first) and he can be Metamei a man, for he has Tum'as Shiv'ah)!

Answer: We answer like R. Avin bar Chiyah taught - Tum'as Ish b'Ish, but not Tum'as Ish b'Kelim.

Question (R. Zerika citing Rav Hamnuna): What was taught there argues with R. Ila!

If a Kli was half from Chalma (Kelim of this material can become an Av ha'Tum'ah), and half from dung, one is not liable for it for Bi'as Mikdash;

Inference: This is because half was from Chalma, and half from dung, but if it were totally from Chalma, he would be liable! (Our text 'ha'Adamah' is difficult, for Kelim of earth do not receive Tum'ah at all! - PF)

Assumption: Who would be liable - is it not one who touched [the Kli, and later entered the Mikdash]? Is he not a Sheni who touched a Rishon?!

Answer (and rejection of assumption - R. Pinchas, in front of R. Yosi): No, the case is, he threw it [into the Mikdash. He is liable for entering a Tamei Kli into the Mikdash.]

Objection (R. Yosi): If he threw it, would it teach about this 'for not washing his body (immersing from Tum'ah before entering the Mikdash), he is Chayav Kares. For not laundering his clothes (immersing from Tum'ah before entering them into the Mikdash, he gets) 40 [lashes] for entering Tamei Kelim into the Mikdash'?!

Yehoshua): Every Tum'as Mes for which a Nazir shaves, one is liable for it for Bi'as Mikdash. Every Tum'as Mes for which a Nazir does not shave, he is exempt for Bi'as Mikdash;

Rebuttal (R. Yochanan): This is needed for Tum'os that separate from a Mes, e.g. a Revi'is of blood or a quarter Kav of bones. A Nazir does not shave for them, he is not liable for them for Bi'as Mikdash. A half Log of blood or a half Kav of bones, a Nazir shaves for them, he is liable for them for Bi'as Mikdash. (However, for a Mes itself, perhaps one is liable even for a Sheni! We explained this entire Sugya based on OHR YAKOV, based mainly on R. SHIMSHON, Taharos 1:2.)

Assumption (R. Yirmeyah): We thought to say that they argue for Korban [for Bi'as Mikdash], but for lashes, all agree that he is lashed, even for a Shelishis, and even for a Revi'is (through Kelim).
