DISQUALIFYING WITHOUT KIDUSHIN (Yerushalmi Perek 7 Halachah 5 Daf 42a)

מתני' האונס והמפתה והשוטה לא פוסלין ולא מאכילין ואם אינן ראויין לבוא בישראל הרי אילו פסולין

(a)

(Mishnah): A rapist, enticer, and a lunatic neither disqualify nor permit eating Terumah. If he is not proper to enter (marry a Bas) Yisrael, he disqualifies.

באי זה צד היה ישראל שבא על בת כהן תאכל בתרומה

(b)

How is this? If he was a Yisrael who had Bi'ah with a Bas Kohen, she may [still] eat Terumah;

עברה לא תאכל נתחתך העובר במעיה תאכל

If she became pregnant [from him], she may not eat. If the fetus was cut up inside her, she may eat.

היה כהן שבא על בת ישראל לא תאכל בתרומה

(c)

If he was a Kohen who had Bi'ah with a Bas Yisrael, she may not eat Terumah;

עיברה לא תאכל ילדה תאכל נמצא כוחו של בן גדול משל אב:

If she became pregnant, she may not eat; if she gave birth, she may eat. It turns out that the child has more power [to feed] than his father!

גמ' הדא אמרה שאין אונסין פוסלין בכהונה בפנויה.

(d)

(Gemara) Inference: Rape of a Penuyah (single woman) does not disqualify to Kehunah.

הדא מסייעא לההוא דתני רבי חייה אשתו של חרש ושל שוטה טובלת מחיק בעלה ואוכלת.

(e)

This supports R. Chiyah's teaching, that the wife (a Bas Kohen) of a [Yisrael] Cheresh or lunatic, she immerses from the lap of her husband, and eats Terumah;

ודלא כרבי לעזר דר' לעזר אומר אף הפנוי שבא על הפנויה שלא לשם אישות הרי זו בעילת זנות.

It is unlike R. Lazar, for R. Lazar says that even a bachelor who has Bi'ah with a single woman not for the sake of Kidushin, this is Bi'as Zenus [and makes her a Zonah].

רבי בא בשם ר' אבא בר ירמיה אנוסה אינה צריכה להמתין ג' חדשים.

(f)

(R. Ba citing R. Aba bar Yirmeyah): One who was raped need not wait three months [to avoid a Safek about who is the father. Surely she turned over after Bi'ah so the semen will fall out, and she will not become pregnant!]

אמר רבי יונה קומי רבי יוסה אמר ליה לא תקבל (עליו) [צ"ל עלך - חשק שלמה] קל הוא באכילת תרומה.

(g)

(R. Yonah in front of R. Yosah): Do not accept this. (Do not learn from our Mishnah, which permits a raped woman to eat, and is not concerned lest she is pregnant.) It is a leniency of eating Terumah (but we are more stringent about lineage, and she must wait three months, like other women).

אילו בת כהן שנישאת לישראל והלך בעלה למדינת הים ושמעה עליו שמת שמא אינה אוכלת בתרומה מיד. ולעניין העובר [דף מב עמוד ב] צריכה להמתין שלשה חדשים.

If a Bas Kohen was married to a Yisrael, and her husband went overseas, and she heard that he died, does she not eat Terumah immediately, [even though] regarding the fetus (in case she is pregnant) she must wait three months [before remarrying, to avoid a Safek about the father]?!

אם אינן ראויין לבוא בישראל הרי אילו פסולין.

(h)

(Mishnah): If he is not proper to enter Yisrael, he disqualifies.

ואלו הן בן תשע שנים ויום אחד גר עמוני ומואבי ומצרי [נראה שצ"ל ואדומי] ועבד וממזר חלל נתין כותי וגוי שבאו על בת ישראל על בת כהן על בת לוי פסולה מן הכהונה.

(i)

The following [disqualify] - a male [at least] nine years and a day old [converted] Amoni, Mo'avi, Mitzri or Edomi, slave, Mamzer, Chalal, Nasin, or Kusi... who had Bi'ah with a Bas Yisrael, Bas Kohen or Bas Levi, she is disqualified from Kehunah;

רבי יוסי אומר כל שזרעו פסול ביאתו פוסלת. כל שאין זרעו פסול אין ביאתו פוסלת

R. Yosi says, anyone whose seed is Pasul, his Bi'ah disqualifies. Anyone whose seed is not Pasul, his Bi'ah does not disqualify;

רבן שמעון בן גמליאל אומר כל שאת מותר בבתו מותר באלמנתו. וכל שאין את מותר בבתו אין את מותר באלמנתו.

R. Shimon ben Gamliel says, anyone that you (a Kohen) may marry his daughter, you may marry his widow (she is still Kesherah to Kehunah). Anyone that you may not marry his daughter, you may not marry his widow.

ומה ביניהון

(l)

Question: What do [R. Yosi and R. Shimon ben Gamliel] argue about?

רבי יוחנן אמר גר עמוני ומואבי ביניהון. מאן דאמר כל שזרעו פסול ביאתו פוסלת. זה הואיל וזרעו פסול ביאתו פוסלת.

(m)

Answer (R. Yochanan): They argue about a converted Amoni or Mo'avi. The one who says anyone whose seed is Pasul, his Bi'ah disqualifies - since his seed is Pasul, his Bi'ah disqualifies;

מאן דאמר כל שאת מותר בבתו אין את מותר באלמנתו. וזה הואיל (ואין את מותר בבתו אין) [צ"ל ואת - קרבן העדה] מותר בבתו את מותר באלמנתו.

The one who says anyone that you may marry his daughter, you may marry his widow - since you may marry his daughter (females of Amon and Mo'av are permitted), you may marry his widow.

דברי חכמים.

Question: [How do we understand] Chachamim's words?

רבי ירמיה בשם (רבי) [צ"ל רבנן ור' - קרבן העדה] בא תריהון אמרין (בה) [צ"ל בת - הגר"ח קניבסקי שליט"א] גר עמוני ומואבי ובת דור שני מצרי אף על פי שאת מותר בבתו את אסור באלמנתו.

Answer (R. Yirmeyah citing Rabanan, and R. Ba): [They forbid the widow even when the children are Kesherim, e.g.] the daughter of a converted Amoni or Mo'avi, or the daughter of a Mitzri Sheni. Even though you are permitted to his daughter, you may not marry his widow. (This is unlike R. Yosi, who permits the widow of a Mitzri Sheni, since his children are Kesherim, and unlike R. Shimon ben Gamliel, who permits even the widow of a Amoni or Mo'avi, since their daughters are permitted.)

Question: R. Zachyei Alexandriyah sent a question - the daughter of a converted Amoni and the daughter of a second generation Mitzri (she is a Shelishis, is she permitted to Kehunah? The case is, he married a convert's daughter, who is permitted to him.)

אמר ליה רבי יוסה לא שמיע לההוא דמר רבי ירמיה בשם רבנן ורבי בא תריהון אמרין בת גר עמוני ובת דור שני של מצרי אף על פי שאת מותר בבתו את אסור באלמנתו.

Question #1: R. Yosah: Did he not hear that R. Yirmeyah citing Rabanan, and R. Ba, both of them said that the daughter of a converted Amoni or Mo'avi, or the daughter of a Mitzri Sheni, even though you are permitted to his daughter, you may not marry his widow?

וכל שזרעו פסול ביאתו פסולה.

Question #2: And [R. Yosi said that] anyone whose seed is Pasul, his Bi'ah disqualifies! (And R. Shimon ben Gamliel said that if the daughter is forbidden, the widow is forbidden. This connotes that all agree that the daughters are permitted, and they argue only about their widows! We explained this like SEFER NIR.)

לא כן צריכה בשהיתה אמה מישראל שלא תאמר כשם שנתחללה אמה כך נתחללה בתה.

Answer (to both questions): [Rather,] he asked about when the mother was a Yisrael (who is forbidden to an Amoni or Mitzri Sheni. Do we say that just like her mother was profaned, her daughter is profaned?

ועוד מן הדא דאמר רבי יעקב בר אחא פליגי ר' יוחנן ורבי שמעון בן לקיש בת גר עמוני ובת דור השני מצרי רבי יוחנן אמר כשירות. ריש לקיש אמר פסולות.

Support: Also, from this (the following, we can say that R. Zachyei was unsure also about whether or not her mother was profaned)! R. Yakov bar Acha said that R. Yochanan and Reish Lakish argue about the daughter of a converted Amoni or the daughter of a Mitzri Sheni - R. Yochanan said that they are Kesheros, and Reish Lakish said that they are Pesulos;

רבי יוסי בי רבי בון אמר בזקינות פליגין. רבי יוחנן אמר כשירות. ריש לקיש אמר פסולות:

R. Yosi bei R. Bun said that they argue about the mothers - R. Yochanan said that they are Kesheros (like R. Shimon ben Gamliel), and Reish Lakish said that they are Pesulos (like the first Tana).

A SLAVE DISQUALIFIES ONLY THROUGH BI'AH (Yerushalmi Perek 7 Halachah 6 Daf 42b)

מתני' העבד פוסל משום ביאה ואינו פוסל משום זרע

(a)

(Mishnah): A slave disqualifies through Bi'ah, but not due to seed:

באי זה צד בת ישראל לכהן בת כהן לישראל וילדה ממנו בן הלך הבן ונכבש על השפחה וילדה ממנו בן הרי זה עבד

How is this? If Reuven was born (1) to a Bas Yisrael from a Kohen or (2) to a Bas Kohen from a Yisrael, and Reuven fathered a child from a Shifchah, the child is a slave;

היתה אם אביו בת ישראל לכהן לא תאכל בתרומה

If [the slave's] father's mother was a Bas Yisrael to a Kohen (case 1), she may not eat Terumah (if Reuven died. Her slave grandchild is not considered seed of a Kohen.)

בת כהן לישראל תאכל בתרומה:

[If the slave's father's mother was] a Bas Kohen to a Yisrael (case 2), she may eat Terumah (if Reuven died).

גמ' העבד מניין שביאתו פוסלת.

(b)

(Gemara) Question: What is the source that a slave disqualifies through Bi'ah?

רבי יוחנן אמר בשם רבי ישמעאל [ויקרא כב יג] ובת כהן כי תהיה אלמנה וגרושה וזרע אין לה שיש לה עליו אלמנות וגירושין חוזרת. את שאין לה עליו אלמנות וגירושין אינה חוזרת.

(c)

Answer (R. Yochanan citing R. Yishmael): "U'Vas Kohen Ki Sihyeh Almanah u'Gerushah v'Zera Ein Lah" - this refers to [one who had Bi'ah with] someone from whom there is widowhood or divorce, she returns [to eat Terumah]. Someone from whom she cannot be widowed or divorced (e.g. a slave, who has no Kidushin), she does not return.

התיב רבי ירמיה הרי (אלמנה) [צ"ל יבמה - נועם ירושלמי, - שערי תורת ארץ ישראל] שזינתה הרי אין לה אלמנות וגירושין וחוזרת.

(d)

Question #1 (R. Yirmeyah): If a Shomeres Yavam had Bi'as Zenus [with a stranger], she has no widowhood or divorce from him, yet she returns!

רבי יוסי לא אמר כן אלא מחלפא שיטתיה דר' יוחנן

(e)

Question #2: R. Yosi did not ask this. Rather, he asked that R. Yochanan contradicts himself!

בגיטין הוא אמר כותין משום מה הן פסולין ר' יוחנן בשם ר' (ישמעאל) [צ"ל לעזר - קרבן העדה] משום גוי ועבד הבא על בת ישראל הוולד ממזר.

[When they were learning] Gitin, he said 'why are Kusim (descendants of the Nochrim whom Sancheriv settled in place of the 10 Shevatim that he exiled) Pesulim? (Even according to the opinion that they converted insincerely, because lions were eating them, they later converted properly!) R. Yochanan citing R. Lazar said, it is because a Nochri or slave who had Bi'ah with a Bas Yisrael, the child is a Mamzer (and such Mamzerim married into Kusim);

[דף מג עמוד א] בקידושין הוא אמר רבי יוחנן ורבי שמעון בן לקיש תריהון אמרין הוולד ממזר.

[Also when they were learning] Kidushin, R. Yochanan and Reish Lakish both said that the child is a Mamzer. (If so, we do not need to learn from "Almanah u'Gerushah" that his Bi'ah disqualifies!)

הכא אמר ליה משום גרמיה. והכא אמר לה משום רבי ישמעאל שכן לדברי חכמים הוולד ממזר.

(f)

Answer: Here (in Gitin and Kidushin) he said so in his own name (or in the name of R. Lazar). Here (regarding our Mishnah) he said so in the name of R. Yishmael [who holds that the child is not a Mamzer, but R. Yochanan disagrees,] for Chachamim say that the child is a Mamzer,

רבי חזקיה לא אמר כן אלא מחלפה שיטתיה דרבי יוחנן

(g)

R. Chizkiyah did not say so. Rather, he asked that R. Yochanan contradicts himself [and according to R. Chizkiyah's version, we cannot answer like above]!

בגיטין הוא אמר הכותין משום מה הן פסולין. רבי יוחנן בשם רבי ישמעאל משום גוי ועבד הבא על בת ישראל הוולד ממזר

(h)

Question: In Gitin, he said 'why are Kusim Pesulim? R. Yochanan citing R. Yishmael said, it is because a Nochri or slave who had Bi'ah with a Bas Yisrael, the child is a Mamzer;

בקידושין הוא. ר' יוחנן ר' שמעון בן לקיש תריהון אמרין הוולד ממזר

[Also] in Kidushin, R. Yochanan and Reish Lakish both said that the child is a Mamzer.

והכא הוא אמר את שיש לו עליו אלמנות וגירושין חוזרת ואת שאין לה עליו אלמנות וגירושין אינה חוזרת.

And here, he said [also in the name of R. Yishmael, after Bi'ah with] 'someone from whom there is widowhood or divorce, she returns. Someone from whom she cannot be widowed or divorced, she does not return'! (If the child is a Mamzer, we do not need this Drashah!)

אמר רבי מתנייא סלקית לסחורה ושמעית ר' יוחנן ור' ישמעאל (בני) [צ"ל בשם ר' - הגר"ח קניבסקי שליט"א] יישוע [ויקרא כב יג] ובת כהן כי תהיה אלמנה וגרושה וזרע אין לה. את שיש לה עליו אלמנות וגירושין חוזרת. ואת שאין לה עליו אלמנות וגירושין אינה חוזרת.

(i)

Answer (R. Masniya): When I ascended to Sechorah (a place), I heard R. Yochanan and R. Yishmael say in the name of R. Yehoshua "u'Vas Kohen Ki Sihyeh Almanah u'Gerushah v'Zera Ein Lah" - someone from whom there is widowhood or divorce, she returns. Someone from whom she cannot be widowed or divorced, she does not return.'

(ואמרת) [צ"ל ואמרתי - קרבן העדה] יאות אין ממזר כר' יהושע שאין ממזר אלא מאשה שהיא אסורה עליו איסור ערוה וחייבין עליה (כרת) [צ"ל מיתה - הגר"ח קניבסקי שליט"א]

I said, this is proper - there is no Mamzer according to R. Yehoshua, [who holds] that there is a Mamzer only from a woman for one is Chayav Misah. (I.e. also R. Yishmael said this Drashah according to R. Yehoshua, but he himself disagrees. We explained this like HA'GAON RAV C. KANIEVSKY, SHLITA.)
