THE ISUR OF BATHING (Yerushalmi Perek 8 Halachah 1 Daf 39a)

ברחיצה ר' זעירה בר חמא רבי יוסי בי ר' חנינא בשם רבי יהושע בן לוי בתענית צבור מרחיץ פניו ידיו ורגליו כדרכו בתשעה באב מרחיץ ידיו ומעבירן על פניו ביוה''כ מרחיץ ידיו ומקנחן במפה ומעביר את המפה על פניו

(a)

[Our Mishnah forbids] bathing. R. Ze'irah bar Chama cited R. Yosi bei R. Chanina in the name of R. Yehoshua ben Levi, that on a Ta'anis Tzibur one may wash his face, hands and feet normally. On Tish'ah b'Av, one may wash his hands and [when they are still wet] pass them over his face. On Yom Kipur, one may wash his hands and dry them on a cloth, and he passes the cloth over his face.

רבי יונה תרי מרטוטה ויהב לה תותי כדה

R. Yonah soaked worn out clothes [on Erev Yom Kipur] and put them under a barrel [to dry out, and on Yom Kipur he passed them over his face].

והא תני אין בין ט' באב לתענית ציבור אלא איסור מלאכה במקום שנהגו

Question: It was taught that the only difference between Tish'ah b'Av and a Ta'anis Tzibur is the Isur of Melachah, in a place where the custom is [not to do Melachah on Tish'ah b'Av]!

היה הולך אצל רבו אצל בתו ועבר בים או בנהר אינו חושש ניטנפו רגליו מטבילן במים ואינו חושש

If one was going to his Rebbi or daughter, and he passed through a sea or river, he is not concerned. If his feet became dirty, he may immerse them in water without concern.

הורי רבי בא כהן תנייא

(e)

R. Ba ruled like this Beraisa [that permits passing through water].

הורי ר' אחא בבא מן הדרך והיו רגליו קיהות עליו שמותר להרחיצם במים

(f)

R. Acha ruled that if one came from the road, and his feet were weary, he may wash them in water.

תני אבל ומנודה שהיו מהלכין בדרך מותרין בנעילת הסנדל לכשיבואו בעיר יחלוצו וכן בט''ב וכן בתענית ציבור.

(g)

(Beraisa): An Avel or Menudah (mourner or someone excommunicated) who were going on the road, they may wear shoes. When they reach the city, they remove them. The same applies to Tish'ah b'Av and a Ta'anis Tzibur.
