DAF DISCUSSIONS - YEVAMOS 2

mark asked:

is the tzara of an ayalonis/sotah only pator from yibum/chalitzah when she is one of the 15 catagories, or does it extend to one who was discovered before ordinary yibum. also does a sotah follow the same logic or is it because she is assur to the brother who died - and what stage does the sotah need to be in in terms of prosecution

mark, nj

The Kollel replies:

(a) The Tzarah of either of the two is always Patur (according to Rav and Rav Asi), even if no Ervah is involved.

(b) The case of Tzaras Aylonis involves a woman who was known to be an Aylonis at the time of her marriage to the dead brother (Gemara 12a).

(c) The Sotah we are discussing is a woman who was proved in court to have committed adultery. It makes no difference how far she was prosecuted. (We are not discussing a "Safek Sotah" who drinks the bitter waters - Gemara 11a).

Best wishes,
