VINES SUPPORTED BY A TRELLIS (Yerushalmi Kilayim Perek 6 Halachah 1 Daf 28a)

(a)

(Mishnah): What is an Aris (vines supported by a trellis that are considered a vineyard)? If one plants a row of five vines next to a fence that is 10 Tefachim tall or next to a furrow that is 10 Tefachim deep and is 4 Tefachim wide; it's given work access of 4 Amos.

Beis Shammai say that they measure 4 Amos from the base of the vine (in order to be able to plant); Beis Hillel say from the fence to the field.

(R. Yochanan ben Nuri): It's a mistake (to express Beis Hillel's view this way). Rather, if there's a distance of 4 Amos from the base of the vines to the fence, they give him work access and he plants the rest. What's the measurement of work access? 6 Tefachim in every direction.

(Gemara) Question: According to Beis Shammai (who said earlier (in the Perek 4 Halachah 5) that one row (of 5 vines) can be considered a vineyard), why would the Mishnah specify that he planted 5 vines next to a fence?

Answer (R. Shimon ben Lakish): The Mishnah is referring to when they are planted in a zig zag (a line of 2 next to a line of 3) rather than in a line.

In such a case, without a fence it would not have been prohibited as a vineyard.

Answer: Just as one may not plant a row of Muksha plants between the holes (of vegetables in the row), so too here, one may not plant between the vines.

(R. Chananya): It is logical to say that R. Shimon ben Lakish agrees with R. Yochanan that according to Beis Hillel, the Mishnah was discussing an Aris in a line.

And R. Yochanan agrees with R. Shimon ben Lakish that according to R. Yochanan ben Nuri the Mishnah was even discussing a zig zag - as R. Yochanan ben Nuri said that all those that say this are mistaken. But if you say that the first Tanna was referring to an Aris in a line, what was the mistake?

Question: What's the different between the opinion (Beis Shammai) that you measure the 4 Amos from the base of the vine and the opinion (Beis Hille) that you measure from the base of the wall?

Answer (R. Yona): (If the Aris was in a zig zag) some of the vine trunks were within 4 Amos of the field and some were outside. According to Beis Shammai, it is fine; according to Beis Hillel, until the place of the string measuring 4 Amos is prohibited for planting; the rest is permitted.

(If the Aris was in a line) there were two Amos between the wall and the vines - according to Beis Shammai, only the first two Amos (on the opposite side of the wall) are prohibited to plant; according to Beis Hillel, an additional two Amos are prohibited.
