BLUNTING THE CHILL OF THE MIKVEH WATER (Yerushalmi Perek 3 Halachah 5 Daf 16a)

תני א''ר יהודה עששות של ברזל היו מרתיחין אותן מעיוה''כ ומטילין לתוך הצונין כדי שתפיג צינתן

(Beraisa - R. Yehudah): They used to heat chunks of iron before Yom Kipur, and cast them into the [Mikveh] water on Yom Kipur, to blunt the chill.

ולא נמצא כמכבה ביוה''כ אלא מסביר סבר ר' יודה שאין אבות מלאכות ביום הכיפורים

Question: This is like extinguishing on Yom Kipur! Does R. Yehudah hold that Avos Melachah are not forbidden on Yom Kipur?!

אלא ר' יודה ור''ש אמרו דבר אחד

Answer #1: R. Yehudah holds like R. Shimon [that the Torah permits Melachah she'Einah Tzerichah l'Gufah].

לא כן סבר מימר ר' יוסי ור''ש שניהם אמרו דבר אחד נימר רבי יוסי ור' יודה ור''ש שלשתן אמרו דבר אחד

Question: [If so, R. Yochanan] should not have said that R. Yosi holds like R. Shimon [that the Torah permits Melachah she'Einah Tzerichah l'Gufah]. He should have said that R. Yosi, R. Yehudah and R. Shimon hold like each other!

אלא מיסבור סבר ר' יודה שאין תולדת האש כאש

Answer #2: Rather, R. Yehudah holds that Toldas Esh (something heated in a fire) is not like a fire [so extinguishing it is not a Melachah].

אלא כיני ר' יודה סבר מימר שאין תולדת אש כאש ורבנן סברין מימר תולדת אש כאש ויחם לו חמין

Question: If you will say that R. Yehudah holds that Toldas Esh is not like fire, and Rabanan hold that Toldas Esh is like a fire (therefore they say to add hot water, and not hot iron, R. Yehudah should agree that) they heat for him hot water! (There is no Isur in this at all. Even if extinguishing Toldas Esh is not a Melachah, it is normally forbidden mid'Rabanan!)

Answer (R. Yehoshua bar Aviyan citing R. Aniyani ben Susyi): The reason of this Tana (R. Yehudah) is lest people say "we saw the Kohen Gadol immerse in Mayim She'uvim (water that was in a Kli) on Yom Kipur.'' (If there was not yet the Shi'ur for a Mikveh, adding Mayim She'uvim disqualifies the Mikveh.)

KIDUSH FOR REMOVING AND DONNING HIS GARMENTS (Yerushalmi Perek 3 Halachah 6 Daf 16a)

מתני' הביאוהו לבית הפרוה ובקודש היתה פרשו סדין של בוץ בינו לבין העם קידש ידיו ורגליו ופשט ר''מ אומר פשט קידש ידיו ורגליו

(a)

(Mishnah): They brought him to Beis ha'Parvah. It was in the Kodesh. They spread a linen sheet between him and the people. He was Mekadesh his hands and feet, and removed his garments; R. Meir says, he removed his garments, and was Mekadesh his hands and feet.

ירד וטבל עלה ונסתפג [דף כא עמוד א (עוז והדר)] הביאו לו בגדי לבן ולבש וקידש ידיו ורגליו

He descended, immersed, arose, and dried himself. They brought to him the white garments. He dressed and was Mekadesh his hands and feet.

בשחר היה לובש פילוסין של שנים עשר מנה ובין הערבים הינדיון של שמונה מאות זוז דברי ר''מ

In the morning he wore [linen garments of] Pilusiya worth 12 Maneh (about six times a normal annual income). In the afternoon he wore [linen garments of] India worth 800 Zuz (eight Maneh). R. Meir says so;

וחכ''א בשחר היה לבוש פילוסים של י''ח מנה ובין הערבים של שנים עשר מנה הכל שלשים מנה

Chachamim say, in the morning he wore Pilusim worth 18 Maneh, and in the afternoon he wore [linen garments] worth 12 Maneh, 30 Maneh in all.

אלו נוטל מן ההקדש ואם רצה להוסיף מוסיף משלו:

This he receives from Hekdesh. If he wants to add (to buy more expensive garments), he adds from his own money.

(Gemara): What is R. Meir's reason? It says "u'Fashat'' and he was Mekadesh his hands, "v'Rachatz'' and he was Mekadesh. (The Torah already taught that he immerses. V'Rachatz teaches about Kidush. It is put between u'Fashat and v'Lavash to teach that there is Kidush for each. It was put between u'Fashat and v'Lavash to teach that he is Mekadesh after removing the garments - HA'GAON RAV C. KANIEVSKY, SHLITA.)

מה טעם דרבנן ופשט ולבש הקיש פשיטה ללבישה מה לבישה מקדש אף פשיטה מקדש

What is Rabanan's reason? "U'Fashat... v'Lavash'' equates removing to putting on. Just like putting on, he is Mekadesh (when dressed), also removing.

(R. Mana in front of R. Yudan): R. Meir holds that [only] Tevilah interrupts (between Kidush and Kidush).

Rebuttal (R. Yudan): You hold that according to R. Meir, he removed, was Mekadesh, immersed, and was Mekadesh? This is not so! Rather, he removed, was Mekadesh, immersed, dressed and was Mekadesh.

(Shmuel): [The Kidush of] removing and [of] dressing are the same - they are la'Ba (for the sake of the garments he will wear).

בר קפרא אמר אחת לבא ואחת לשעבר שתיהן לבוש

(Bar Kapara): One [of dressing] is la'Ba, and one [of removing] is leshe'Avar (for the sake of the previous garments). Both of them are when he is wearing the garments.

(R. Yochanan): All (Shmuel and Bar Kapara) agree that the first Kidush is la'Ba.

Support (R. Yosah - Mishnah): They brought to him his own clothes, and he put them on. Is one Mekadesh his hands and feet for Chulin clothes?!

(R. Yochanan): "U'Levesham'' - wearing [the garments] is Me'akev, but Tevilah is not Me'akev. Similarly, wearing is Me'akev, but Kidush of hands and feet [after the first one] is not Me'akev.

R. Shmuel bar Rav Yitzchak did not go to the Beis Midrash. He met R. Ze'ira, and asked what Chidush was in the Beis Midrash today. He said "Vad'' - they should be double. This is unlike R. Yosi;
