Orlah and Reva'i

תלמוד בבלי מסכת ראש השנה ט:- י.	Rosh Hashanah 9b - 10a
תנו רבנן, אחד הנוטע אחד המבריך ואחד המרכיב ערב שביעית שלשים יום לפני ראש השנה, עלתה לו שנה ומותר לקיימן בשביעית; פחות משלשים יום לפני ראש השנה לא עלתה לו שנה ואסור לקיימן בשביעית. ופירות נטיעה זו אסורין עד חמשה עשר בשבט, אם לערלה ערלה ואם לרבעי רבעי. מנא הני מילי... אמר קרא ובשנה הרביעית... ובשנה החמישית (ויקרא יט:כד-כה), פעמים שברביעית ועדיין אסורה משום ערלה, ופעמים שבחמישית ועדיין אסורה משום רבעי.	A Beraisa: When planting, bending the runner of a plant into the earth to take root, or grafting, before the beginning of the Shemitah year: If at least 30 days remain until Rosh Hashanah, it is counted as Year 1 for Orlah, and the tree may be preserved through Shemitah; whereas if less than 30 days remain until Rosh Hashanah, it does not count as Year 1 for Orlah, and it may not be preserved through Shemitah. [In the first case], the fruit of this sapling is prohibited as Orlah [even after Rosh Hashanah of Year 4] until 15 Shevat. Likewise, Reva'i extends to fruits that grow until 15 Shevat of Year 5. How do we know [that the years of Orlah and Reva'i are to be extended]? ... The Torah says (Vayikra 19:23-24) "[It is Orlah]; and in the fourth year [... it is Reva'i];" (the prefix "and" implies that the prohibition of Orlah can extend into part of the fourth year). Likewise, the Torah says (Vayikra 19:24-25) "[It is Reva'i]; and in the fifth year [... it is totally permitted]" (the prefix "and" implies that the laws of Reva'i can extend into part of the fifth year).

ד. ג' שנים הללו אינם נמנים מיום ליום, אלא הולכים בהם אחר שנות העולם שהוא מתחיל מתשרי ... ולאחר ר"ח תשרי של שנה רביעית, כל הפירות שיחנטו בו קודם ט"ו בשבט יש להם גם כן דין ערלה, אף על פי שנגמרים אחר כך. והנחנטים בו מט"ו בשבט של שנה רביעית עד ט"ו בשבט של שנה חמישית, נקראים רבעי. ולאחר ט"ו בשבט של שנה חמישית הם חולין גמורים.	4. These three years are not counted by the precise date; rather, we follow the general count of years, which begin in Tishrei... However, even after 1 Tishrei of Year 4, any fruit that buds prior to 15 Shevat of that year still has the status of Orlah - even if it reaches completion only thereafter. Fruit that buds between 15 Shevat of Year 4, and 15 Shevat of Year 5, is Reva'i. After that, it is normal fruit.
ה. הא דאמרינן שלאחר ר"ח תשרי של שנה רביעית כל הפירות שחנטו קודם ט"ו בשבט יש להם גם כן דין ערלה אף על פי שנגמרים אחר כך, דוקא בנטיעה שהקלנו עליה בתחילתה ... הא לאו הכי, לא. ויש אומרים דלא שנא.	5. What was stated above -- that even after 1 Tishrei of Year 4, any fruit that buds prior to 15 Shevat is still Orlah -- applies only to a planting for which we were lenient at the outset (by counting an abbreviated Year 1)... but otherwise it does not apply. But some say that in any case [we must be strict].
