Malbim: "Kol Kavel Di Hava Aved Min Kadmas Denah" ? Daniel always used to pray to Hashem. The king's decree was only about a new particular request; one must ask the king, and he will fulfill it. This does not apply to Tefilah ? praise of Hashem, and requests for the Klal ? life, pardon? The king did not intend to make people nullify Mitzvos of their gods. Daniel would not have been Moser Nefesh for Tefilah, for the decree was not intended to uproot Torah. The Ramban holds that Tefilah is only mid'Rabanan!
