Radak: It is the Bris that Elokim made with them on Har Sinai. Malbim - the Bris is one of three reasons why Hashem strove to save them - however, they did not guard it! Also refer to 78:10:2:1, 78:11:1:1.

Malbim: Hashem wanted to save them in the merit of guarding Torah - however, they did not guard it!
